Not every bad medical outcome is negligence — but some are.
Medicine is not perfect, and even with proper care, a diagnosis can be difficult or a condition can worsen. That alone isn't negligence. The line is crossed when a healthcare provider fails to do what a reasonably competent professional would have done in the same circumstances — missing or delaying a diagnosis that should have been caught, ignoring clear symptoms, or failing to order the tests the situation called for — and that failure causes real harm.
The key questions are whether the standard of care fell short, and whether that shortfall caused or worsened the injury. Those aren't always easy to answer, which is where proper legal and medical assessment comes in.
If you believe a missed or delayed diagnosis caused you harm, Simpsons can advise whether it may amount to negligence.
