WHO IS RESPONSIBLE FOR SPECIAL LEVIES: OLD OR NEW OWNER
Section 3(3) of the Sectional Title Schemes Management Act (STSMA) states that in the event that special levies are payable pro- rata and not in a lump sum, the new owner will become liable for payment pro rata from date of registration.
It reads as follows:

“Any special contribution becomes due on the passing of a resolution in this regard by the trustees of the body corporate levying such contribution and may be recovered by the body corporate by an application to an ombud from the persons who were owners of units at the time when such resolution was passed. Provided that upon the change of ownership of a unit the successor in title becomes liable for the pro-rata payment of such contributions from the date of change of such ownership.”

If you are purchasing a sectional title unit or a property that is subject to levy, be sure to ask whether any special levy resolutions have been passed and whether you will be liable for payment or the previous owner.

EXEMPTION FROM PAYING TRANSFER DUTY IN CERTAIN ESTATE AND DIVORCE TRANSFERS
To qualify for the exemption, the following requirements must be met:

• the sole ownership in the whole or any portion
• of the property registered in the name of the deceased or divorced spouse
• must be acquired
• by the surviving spouse or the other divorced spouse;

• the transfer must be the result of the death or dissolution of the marriage 'or union', as the case may be
Example: X owns a half share in Erf 123 (his brother owns the other half). X is married to Y out of community of property. In the settlement agreement relating to a divorce, it is agreed that Y will get X's half share in Erf 123. This transfer will be exempt in terms of section 9(1)(i) of the Transfer Duty Act.

Clarity on the effective date and the scope of the application of the transfer duty exemption between divorced spouses.

VALIDITY OF COMPLIANCE CERTIFICATES:

ELECTRICAL COMPLIANCE: At present the electrical certificate can only be valid for an absolute maximum of two years, subject to no alterations or work being done during that period.
GAS COMPLIANCE: This certificate is valid for a period of five years
BEETLE COMPLIANCE: this certificate has a limited validity and is only valid for 3 to 6 months and usually only for the period of the transfer.
WATER/PLUMBING COMPLIANCE: This certificate is valid for a period of five years

What does prescription mean?

Did you know that certain debts or monies owing can prescribe after a certain period of time? In most instances a party will only have 3 years to claim (issue summons) from when a debt became due. If summons is not served within this period the debt would have prescribed and you will not be able to recover same from the debtor.
