BREAKING NEWS: A full bench of the Supreme Court of Appeal today found in favour of Signature Real Estate, setting aside the order of the Western Cape High Court and ordering Atlantic Seaboard Realty to pay the commission due to Signature together with interest and costs. The court found that although Signature was not in possession of a Fidelity Fund Certificate at the time that the disputed commission was earned, that this was due to the fault of the Estate Agency Affairs Board. The court found that “Signature had complied with this and all other requirements of the Act. But for the error on the part of the Board, Signature was entitled to, and would have been issued with, a valid Fidelity Fund certificate for the period 1 January- 31 December 2018.” Persons interested in the judgment can contact our firm for more information.
