The recent attack on a six-year-old child in Umhlali has understandably caused shock, anger and deep concern in our community.

What happened was serious. A child was harmed, and that should never be minimised.

At the same time, cases involving minors raise difficult legal questions, because South African law does not treat children in exactly the same way as adults when criminal responsibility is assessed.

That is where the concept of criminal capacity becomes important.

The law looks at age, but it also considers whether a child was capable of understanding the wrongfulness of their conduct and acting in accordance with that understanding. But an employer cannot simply decide to deduct money from an employee’s salary whenever something goes wrong. Under South African employment law, deductions from remuneration are regulated. In general, they must either be agreed to in writing or be authorised by law, a collective agreement, court order or arbitration award. Where loss or damage is involved, fair procedure also matters.

That distinction matters, because workplace accountability and lawful salary deductions are not the same thing.

Capacity is a fundamental part of criminal responsibility.

In criminal law, it is not always enough to ask what happened. The law may also consider whether the person had the mental capacity to understand the wrongfulness of their conduct, and whether they were able to act in accordance with that understanding.

This is why capacity can change the legal question entirely.

The case of S v Chretien remains an important reminder that issues such as intoxication and criminal capacity can affect how criminal responsibility is assessed.
