When buying property in South Africa, one of the important cost details to confirm upfront is whether the transaction is subject to VAT or Transfer Duty.

It is not both.

If the seller is VAT-registered and the property forms part of their business enterprise, VAT may apply. If not, Transfer Duty is usually payable by the buyer. SARS confirms that a property sale is subject to either VAT or Transfer Duty, with VAT taking preference where it applies.

Property transfers involve more than just signing documents and municipal rates are a perfect example of where people get caught off guard.

Before transfer can proceed, the municipality issues a Rates Clearance Certificate. But hereโ€™s what many people donโ€™t realise: the figures paid for this certificate are not a final account. They are an advance payment, usually covering several months ahead, to ensure the property is โ€œin creditโ€ at the time of transfer.

What happens next is where things often go wrong:
* The seller has effectively overpaid rates to secure the certificate. After transfer, they must apply to the municipality for a refund of any credit remaining on the account. This does not happen automatically - and delays are common if not followed up.

* The purchaser must open a new municipal account in their own name as soon as the property is registered. If this step is missed or delayed, billing issues and confusion around liability can arise quickly.

The key point: the clearance process is designed to protect the municipality - not to neatly settle accounts between buyer and seller.
