βοΈ LABOUR LAW FACT FOR EMPLOYERS!
NO SIGNED CONTRACT? THAT DOESN'T MEAN NO EMPLOYMENT RIGHTS!
π‘In South Africa, an employment relationship can exist even without a signed written contract?
A verbal agreement between an employer and employee can establish an employment relationship. However, employers should never underestimate the importance of clearly documented employment terms.
π EMPLOYER TIP: A written employment agreement helps establish expectations, responsibilities, working hours, remuneration and workplace rules from the beginning.
Under Section 29 of the Basic Conditions of Employment Act (BCEA), employers are generally required to provide employees with written particulars of employment when employment begins.
