DELHI HIGH COURT GRANTS INTERIM RELIEF TO ‘UPSTOX’

Justice Mini Pushkarna on dated 28th December, 2024 grants interim injunction in a Trademark & Copyright infringement suit filed by RKSV Securities India Private Limited, an online trading application named UPSTOX against unidentified users.

UPSTOX a leading brokerage company registered with SEBI, URDAI & PFRDA alleged that several unanimous entities are infringing their intellectual properties via impersonation.

Honb’le Justice Mini Pushkarna upon hearing the case, recognised this as a strong case for granting an interim injunction to prevent irreparable harm without immediate legal protection.

🔸 Prohibiting unidentified parties from further use of UPSTOX’s intellectual properties including trademarks, styles, wordmarks, images & domain names.
🔸 Domain registrars to make public ownership detail of infringing domains and to suspend alleged activity.
🔸 Mandated banks to provide KYS details of alleged Bank Accounts, Transaction Details & to Freeze them.
🔸 Directed Telegram to shut-down alleged channels linked to impersonators.

The court has scheduled the next hearing on May 20, 2025 providing an opportunity for the defendants to respond to the allegations made in this suit. The interim injunction is placed offering immediate relief to the Plaintiff.

Below is the latest Annual data published by the office of the Ministry of Commerce & Industry, Government of India for the period 2022-23.

Hope the Chief Minister Nitish Kumar and the Honb’le Prime Minister Shri Narendra Modi Ji may take note of this.

We understand this figure is not correct if data is prepared on the basis of “Applicant’s Address of Communication” rather prepared on the basis of “Agent’s / Attorney’s Address of Service”.

Etumon and the Law Office of Nikita urge the State Government to consider such robust plan to bring considerable change in future.

We can suggest the following:-
(1) The Office of the CGPDM should publish data based on the “Applicant’s Address of Communication”.
(2) The Government of Bihar should pass such order that such Patent, Design, Trademark & Copyright related services be sourced from or consultants be hired from local as a preference and such order be effective to all State Government Departments, Universities in Bihar and other Central Government Research Organizations in Bihar.
(3) The DPIIT, Ministry of Commerce & Industry, Government of India should pass such necessary orders as deem fit.
