[MỨC LƯƠNG TỐI THIỂU VÙNG 2026] #2
⁉️“SINH VIÊN ĐI LÀM THÊM ĐƯỢC TRẢ 18.000 ĐỒNG/GIỜ” - CÓ ĐANG DƯỚI MỨC TỐI THIỂU THEO QUY ĐỊNH MỚI CỦA 2026?
(English caption below)
Vùng I: 5.310.000 đồng/tháng và 25.500 đồng/giờ

[REGIONAL MINIMUM WAGE 2026] #2
⁉️“STUDENTS WORKING PART-TIME ARE PAID VND 18,000/HOUR” - IS THIS BELOW THE NEW 2026 MINIMUM WAGE THRESHOLD?
⚖️A very common legal scenario at the start of each academic year: Newly enrolled students take part-time jobs to gain experience and cover living expenses. The work seems light, the employer offers VND 18,000/hour, and many students find it reasonable.
📜However, from January 1, 2026, the relevant legal benchmark is the regional statutory minimum wage - both hourly and monthly - as prescribed under Decree No. 293/2025/NĐ-CP.
🤔So what is the answer to the question many students (and employees in general) are concerned about?
1️⃣ Under Article 90 of the 2019 Labour Code, the wage for the job/title must not be lower than the minimum wage
Pursuant to the 2019 Labour Code, remuneration includes: (i) wage for the job/title + (ii) allowances + (iii) other additional payments. Importantly, the wage for the job/title must not be lower than the applicable statutory minimum wage.
Example: A student works part-time as a waiter in Region III (minimum VND 20,000/hour) and agrees to: VND 18,000/hour + tips/bonus depending on the day. Since tips/bonuses are variable and not guaranteed, the student is legally entitled to receive at least VND 20,000/hour as the minimum wage, with tips/bonuses calculated separately.
2️⃣ VND 18,000/hour may be lawful in one region but unlawful in another
Under Decree No. 293/2025/NĐ-CP, the regional minimum wage rates are:
Region I: VND 5,310,000/month and VND 25,500/hour
Region II: VND 4,730,000/month and VND 22,700/hour
Region III: VND 4,140,000/month and VND 20,000/hour
Region IV: VND 3,700,000/month and VND 17,800/hour
👉🏻Accordingly, VND 18,000/hour is below the minimum wage if the workplace is in Region I - III (minimum VND 20,000 - 25,500/hour), but above the minimum wage if it is in Region IV (minimum VND 17,800/hour).
📌The key legal issue is not the type of worker or the nature of the job, but primarily: (i) the place of work (region) and (ii) the wage payment method (hourly/monthly/other) for proper comparison.
3️⃣ Common misconceptions can cost employers more than they gain
- “Part-time work is not subject to minimum wage rules” → Incorrect. Decree No. 293/2025/NĐ-CP explicitly provides hourly minimum wage rates, which apply where wages are paid by the hour.
- “No contract means no legal obligations” → Risky. In practice, an employment relationship may still be assessed based on factors such as work performance, wage payment, supervision/management, etc. In the event of disputes or inspections, the employer may be disadvantaged due to lack of evidence.
- “A low basic wage is acceptable if allowances make up the difference” → Incorrect. The law emphasizes that the wage for the job/title must not be lower than the minimum wage.
4️⃣ Checklist for both employees and employers
🧑💻If you are a part-time worker:
- Confirm the workplace location (to determine the applicable region).
- Identify the wage payment method: hourly or monthly/shift/piece-rate (conversion may be required for comparison).
- Keep basic evidence: shift/roster messages, timesheets, and bank statements/pay records.
🧑💼If you are an owner/manager/HR:
- Determine the correct applicable region based on the operating location: each branch applies the region where it operates; if an industrial zone spans multiple areas, apply the highest rate.
- For hourly wages: ensure the wage for the job/title (per hour) is not lower than the hourly minimum wage.
- For shift/day/week/piece-rate/output-based pay: convert to hourly or monthly figures to ensure compliance with the “not lower than” threshold.
- Standardize documentation: work agreements, wage calculation method, pay cycle, timekeeping, etc., to mitigate dispute risks.
✅CONCLUSION: Receiving VND 18,000/hour is lawful in Region IV, but unlawful in Regions I - III under the rules effective from 01/01/2026.
