Vietnam has launched a nationwide campaign against intellectual property (IP) infringements from 7 to 30 May, with a strong emphasis on administrative reform, digital transformation, and enhanced protection for digital assets, artificial intelligence, and e-commerce.

Sharing his perspective on these developments, our Senior IP Consultant at BMVN in strategic alliance with Baker McKenzie Vietnam, Peter N. Fowler, spoke with Vietnam Today about how the country is strengthening its response to increasingly sophisticated IP violations.

Over the past year, Viet Nam has accelerated efforts to modernise its intellectual property (IP) regime, with particular emphasis on enforcement, an area long scrutinised by foreign investors assessing market and operational risk. At the same time, attention has increasingly shifted from what the law provides to how it functions in practice. This distinction came into sharper focus on April 30, 2026, when the US Trade Representative (USTR) designated Viet Nam a “Priority Foreign Country” in its annual Special 301 Report.

Our senior IP consultant Peter N. Fowler and associate Anh Thu (Alison) Nguyen from BMVN, the strategic alliance of Baker McKenzie Vietnam, have just featured in Nhan Dan (People) Newspaper (the official newspaper of the Communist Party of Vietnam), sharing their insights on Viet Nam’s evolving IP enforcement framework and what recent reforms signal for foreign investors.

Baker McKenzie Vietnam is pleased to have advised OKX, a leading global digital assets exchange and Web3 technology company, on its strategic investment in CAEX Vietnam ("CAEX"), a locally developed crypto asset exchange platform. Alongside the founding Vietnamese shareholders, VPBankS and LynkiD, the parties aim to develop a Vietnam-focused digital asset exchange platform. Baker McKenzie Vietnam advised OKX on all aspects of the transaction, including regulatory advice, transaction documentation and negotiations.

This transaction highlights Baker McKenzie’s experience in advising global digital asset platforms and Web3 companies on complex, cross-border investments in Vietnam and across Southeast Asia, particularly in emerging and highly regulated sectors.

The Baker McKenzie Vietnam team was led by Partner Chris Milliken, together with Senior Associate Vu Quynh Trang Nguyen. Associates Thi Loan Mai and Thi B**h Hanh Phan provided support on the M&A/investment side.

Baker McKenzie Vietnam has advised the Mandated Lead Arrangers, Underwriters and Bookrunners, including Cathay United Bank, CTBC Bank, Landesbank Baden Württemberg, Mizuho Bank, and Taipei Fubon Commercial Bank, in connection with the US$488 million unsecured syndicated loan to Techcom Securities - TCBS, the largest syndicated facility ever recorded for a securities firm in Vietnam.

As detailed in TCBS’ announcement (https://lnkd.in/gTqNneNv), the transaction attracted participation from 26 lenders across Asia, Europe, and the Middle East, reflecting one of the most diverse lender bases seen in comparable Vietnamese securities transactions. The proceeds are expected to enhance TCBS’s margin lending capacity and support its investment and market‑making activities, strengthening its ability to navigate evolving market conditions.

The Baker McKenzie team was led by Managing Partner Oanh Nguyen and Special Counsel Ngo Thai Ninh (Daniel) in Vietnam, together with Principal Emmanuel Hadjidakis in Singapore, with support from Associate Hoang Nguyen Dang in Vietnam and Local Principal Amanda Toh, Associate Vinny Yap, and Trainee Whang Chia Ning in Singapore.

Baker McKenzie Advises APM Terminals on First Seaport Investment in Vietnam

We are delighted to have advised APM Terminals, part of A.P. Moller–Maersk, on its acquisition of a 49% stake in Hateco Hai Phong International Container Terminal (“HHIT”), the most advanced and the largest deep-water port in North Vietnam, comprising two new deep-water berths at the Lach Huyen area of Hai Phong City.

As detailed in the company’s press release, APM Terminals will join the ownership of HHIT as minority shareholder and operating partner alongside the Hateco Group. The transition represents a significant milestone for the terminal, which has progressed from groundbreaking to becoming an efficiently operated facility capable of servicing vessels of up to 18,000 TEU.
