Văn phòng Cục Sở hữu trí tuệ ra thông báo số 100/TB-VP ngày 13/03/2025 về việc thay đổi tên giao dịch tại tài khoản kho bạc của Văn phòng cục

Văn phòng Cục Sở hữu trí tuệ nhận được thông báo, kể từ ngày 15/3/2025, “Kho bạc Nhà nước Thanh Xuân” sẽ chuyển tên tên thành “Phòng Giao dịch số 5 – Kho bạc Nhà nước Khu vực I”. Theo đó, Văn phòng Cục hướng dẫn như sau:

1. Đối với Người nộp đơn đăng ký quyền sở hữu công nghiệp

Người nộp đơn nộp đăng ký quyền sở hữu công nghiệp (SHCN) tại Cổng dịch vụ công trực tuyến của Cục SHTT, sau đó gửi Giấy xác nhận của Ngân hàng về việc đã chuyển tiền nộp phí, lệ phí SHCN kèm theo Phiếu xác nhận nộp đơn trực tuyến về Cục Sở hữu trí tuệ.

Người nộp đơn nộp các khoản phí, lệ phí SHCN đến tài khoản sau:

Tên tài khoản: Văn phòng Cục Sở hữu trí tuệ

Số tài khoản: 35110105488900000

Tại: Phòng Giao dịch số 5 – Kho bạc Nhà nước Khu vực I (thay cho tên cũ là Kho bạc Nhà nước Thanh Xuân trước đây).

Lưu ý: Khi nộp tiền, Người nộp đơn ghi rõ nội dung nộp tiền, tên chủ đơn và số đơn SHCN/mã số đơn trực tuyến.

Người nộp đơn có thể tra cứu về đơn đã được tiếp nhận trên tài khoản trực tuyến của mình. Biên lai thu phí, lệ phí SHCN sẽ được gửi cho Người nộp đơn qua địa chỉ email khai trên hồ sơ đăng ký xác lập quyền SHCN.

Các hình thức nộp phí, lệ phí SHCN trực tiếp tại trụ sở Cục và qua tài khoản của Văn phòng Cục tại Ngân hàng thương mại không thay đổi.

2. Đối với các đơn vị trực thuộc Cục Sở hữu trí tuệ

Cập nhật thông tin về tên Phòng giao dịch mới như trên trong các hồ sơ, tài liệu, chứng từ thanh toán tại Văn phòng Cục.

👉 Stage 1: Formality examination of patent
National Office of Intellectual Property (NOIP) will examine the formality of the patent application within 1-2 months counted from the filing date. However, the actual time may be longer.

👉 Stage 2: Publication of patent on Vietnamese IP Gazette
NOIP shall publish the patent application on Vietnamese IP Gazette within 19 months counted from the first filing date or date of accepting its legitimate whatever comes later.
The applicant could ask for earlier publication of their patent application.

👉 Stage 3: Substantive examination of patent
NOIP shall issue the substantive examination result 18 months from the publishing date. If the result is positive, the patent shall be granted within 1-2 months. Otherwise, patent applicant shall have three months (extensible for 3 months) to respond to the rejection.

👉 Stage 4: Granting Vietnam patent
Within 1-3 months from the notice of patent granting.

On 09 September 2021, IP Vietnam released Notice No. 8181/TB-SHTT ("Notice No. 8181") in support of applicants during the ongoing COVID-19 outbreak. By virtue of Notice 8181, the statutory deadlines that fall between 30 June and 31 October 2021 are automatically extended until 30 November 2021

The types of deadlines that will be extended:
· Supplement of documents
· Responses to IP Vietnam's decisions/notices
· Maintenance or renewal of patents or registrations
· Payment of official fees
· Appeal/complaint filings.

New deadline:
Under Notice No. 8181, all statutory deadlines that fall into the prescribed categories are automatically extended until 30 November 2021.
