About the Helpdesk:

The South-East Asia IP SME Helpdesk supports European Union (EU) small and medium sized enterprises (SMEs) to both protect and enforce their Intellectual Property (IP) rights in or relating to South-East Asian region, through the provision of free information and services. These take the form of jargon-free, first-line, confidential advice on intellectual property and related

issues, plus training, materials and online resources. The South-East Asia IP SME Helpdesk project is co-funded by the European Commission's Directorate-General for Enterprise and Industry under the Competitiveness and Innovation Framework Programme (CIP). The current project will run from January 2015 – December 2017, and comprises a total budget of EUR 2.4 million over the two year period. The main factors determining whether a company is classed as a small or medium sized enterprise (SME) are:

The number of employees is less than 250
Either the turnover is less than EUR 50 million, OR the balance sheet total is less than EUR 43 million

Helpdesk Enquiry Service – Confidential Advice
Individual SMEs and SME intermediaries can submit IP enquiries directly to the Helpdesk via phone, email or in person, getting access to a panel of experts to receive free and confidential first-line advice. Training – The Helpdesk arranges training on South-East Asia IP protection and enforcement in Europe and ASEAN, tailored to the needs of SMEs, including:
1) General IP issues, including IP registration and establishing an IP protection strategy.
2) Practical business challenges such as choosing an ASEAN business partner, attending a trade fair, licensing. Helpdesk IP Clinics, offering SMEs free 20 minute one-on-one consultations with an IP expert, are available at most training events. Train-the-trainer resources for SME service providers and intermediary bodies (Trade Associations, SME Networks etc.) to improve the awareness of intermediary representatives about the scope and tools offered by the Helpdesk for the benefit of intermediary members. Materials – Industry and business-focused guides and training materials address ASEAN IP issued by:

1) IP topic, including patents, trademarks, copyrights, licensing, dealing with counterfeiting.

2) Business focus, including IP as a business asset, technology transfer, finding the right lawyer.

3) Nation and Industry, including textiles, medical devices, ceramics. Online Services – The multi-lingual online portal provides easy access for all EU SMEs to Helpdesk information and services, including Helpdesk guides, E-learning modules, videos, podcasts, event information, and live webinars.

In the discussion of Taylor Swift’s registration of oral phrases like “Hey, it’s Taylor Swift” to act against the rise of generative AI in mimicking human voices, audio branding (sound trademark) becomes a vital tool in protecting the business in the digital era.

In specific, trademarks can be jingles, app launch sounds, or signature vocal phrases like producer tags. Consumers shall immediately recognise the service/products upon hearing them, such as the intro song of 20th Century Studios, Nokia’s ringtone, or Netflix’s signature “ta-dum” sound.

As an emerging market for sound marks protection, Thailand's Department of Intellectual Property (DIP) strongly encourages companies and celebrities to register sound marks to protect their commercial identities. Up till now, Thailand has recorded 494 sound mark applications, with 114 successfully registered. Along with e-commerce thrive, this trademark type is becoming an inevitable trend but also imposes risks on businesses that neglect to protect it, i.e., deep-fake voice-cloning technology or AI distortion of audio.

Maurten is a well-known Swedish sports nutrition brand and recognized globally for its energy gels products incorporated hydrogel technology. Owning a well-known brand without trademark protection in Vietnam, the company faced a situation of local trademark squatting (someone registers a trademark that belongs to another entity in a market where the legitimate owner has not yet registered).

In this case, a local individual filed a trademark registration application for a mark which was identical to Maurten’s distinctive logo. The Swedish company then had to submit the opposition (a procedure in objecting applications before the IP Office) against this mark, otherwise consumers might mistakenly connect this mark with the company’s business. Normally, owners of prior registered trademarks are more likely to succeed in opposing conflicting trademark applications. However, the company had neither registered nor applied for any trademarks in Vietnam. It therefore pursued another strategic approach: emphasis on the copyright protection of the logo itself and the trademark squatter’s bad faith intention, because copyright arises automatically in Vietnam without having to register.

Vietnam IP Office has traditionally been cautious in endorsing copyright as a basis for refusing trademark applications. Yet ultimately, the opposition result was concluded in favor of Maurten’s side: the IP Office accepted the copyright arguments and refused the conflicting mark’s registration.

The case suggests that multi-layered IP protection can be impactful, and regular monitor helps brand owners duly catch the copycats and stop infringement, especially in local emerging markets.

Registered your trademark in the Philippines? That may not be the end of the story.

In some jurisdictions, in this case – the Philippines, trademark owners are required to submit the Declaration of Actual Use (DAU), which is a post-registration procedure, demanding the owners file evidence of use of their marks in commercial activities before the Intellectual Property Office of the Philippines (IPOPHL).

However, not all kinds of evidence will be approved. IPOPHL issued the Draft DAU Guidelines providing clearer examples but also stricter conditions for the evidence. Whether the distributed products are goods or services, the trademark owner is required to show that the marks are directly associated with the goods/attached in the rendering of services and are clearly used in the Philippine market. IPOPHL also recognises online proof (such as website screenshots or social media posts), but they need to be verified and valid to prove genuine commercial intention of the owner.

Some might find the requirements more stringent and burdensome, but the issuance of this Guideline conveys a clear message for companies in this market: trademark filing strategies should align with careful post-registration management and credible proofs of commercial use.

A recipe may sound ordinary, but in IP terms it can be a valuable trade secret. In the F&B industry, trade secrets are often one of the most practical ways to protect confidential know-how, because they can cover recipes, formulas, preparation methods, and other information that gives a business a real market advantage.

This is why some of the world’s most famous F&B companies have relied on trade secrets. A prime example is the Coca Cola’s formula which has been strictly preserved for more than 100 years, but it is far from the only one. Other well-known trade secrets include Nestle’s coffee blending and roasting process, Hersey’s chocolate-making process, and Mc Donald’s special sauce. So, when you are tasting a bar of Hersey chocolate or dipping fries in Mc Donald’s sauce, you are enjoying the legacy of business secrecy for decades.

For small F&B companies, your crafted drinks, signature dishes, or an innovative production process, even ingredient designs can start as something simple, but over time it may become one of the most valuable assets of businesses. The important point is that secrecy is not automatic protection: companies must take reasonable steps to keep the information confidential.

🟥 Southeast Asia's (SEA) IP landscape is blooming, especially for trademark filings. In 2024, 3 SEA middle-income countries i.e. Indonesia, Vietnam, and the Philippines demonstrated significant trademark filing activity with 260K+ classes of products or services. However, IP offices often refuse trademark registration by issuing notifications to applicants thereby creating uncertainty for European SMEs.

❌ Most SEA countries follow the first-to-file principle, meaning the first entity or person to file a trademark application and obtain protection will own the right. Waiting too much before filing your trademark may lead to the issuance of provisional refusal notifications. Handling this issue is both time and cost-consuming for SMEs. Therefore, getting familiar with the common grounds of refusal should better equip you and the employees of your company.
