USCIS Encourages Eligible Applicants to Switch to EB-1 or EB-2 Categories

Due to an exceptionally high number of employment-based immigrant visas available in the EB-1 and EB-2 categories during this fiscal year (October 2021 - September 2022), the USCIS urges eligible applicants (professionals with advanced degrees or with exceptional ability) to consider requesting a transfer of their pending adjustment of status application from EB-3 to the EB-1 or EB-2 categories.

The Department of State Waives In-Person Interview Requirement For Certain Non-Immigrant Visas Through the End of 2022

The Department of State has extended the waiver of the in-person interview requirement for certain temporary nonimmigrant visa applicants, including F, M, and academic J visas and certain H-1, H-2, H-3, H-4, L, O, P, and Q with approved petitions. To qualify, applicants must be either :

I. Applicants renewing any visa within 48 months of expiration; and
*They are applying for a visa in their country of nationality or
residence;
*Have never been refused a visa unless such refusal was overcome
or waived; and
*Have no apparent or potential ineligibility to receive a visa.

OR

II. Applicants applying for an initial visa;
*Who are citizens or nationals of a country that participates in the
Visa Waiver Program (VWP);
*Have no apparent ineligibility or potential ineligibility; and
*Have previously traveled to the United States using an
authorization obtained via the Electronic System for Travel
Authorization (ESTA) .

H-1B Applicants and H-2B Applicants

✅Healthcare professionals
✅Travel supported by a request from a U.S. government agency
✅Travel by applicants seeking to resume ongoing employment in the United States
✅Travel by technical specialists, senior level managers and other workers whose travel is necessary to facilitate the immediate and continued economic recovery and etc.

J-1 Applicants

✅ Travel to provide care for a minor U.S. citizen, LPR or nonimmigrant in lawful status by an au pair possessing special skills required for a child with particular needs (e.g., medical, special education or sign language)
✅Childcare services provided
✅An exchange program conducted pursuant to an agreement between a foreign government and any federal, state or local government entity
✅Interns and Trainees on U.S. government agency-sponsored programs
Programs where an exchange visitor participating in an exchange program fulfills critical and time sensitive foreign policy objectives.

L-1A Applicants and L-1B Applicants

✅Public health or healthcare professionals, or researchers to alleviate the effects of the COVID-19 pandemic
✅Senior level executives or managers filling critical business needs of an employer meeting a critical infrastructure needs.
