📌 CHANGING THE MARKETING AUTHORIZATION HOLDER IN VIETNAM: A FASTER AND FEASIBLE APPROACH ✅
Recently, MedNovum has observed that many medical device Manufacturers are showing a “trend” of designating an independent third party as the Marketing Authorization Holder (“MAH”) to allow flexibility in changing distribution channels when necessary, instead of allowing distributors to continue holding an exclusive position as in the “traditional” approach. However, the biggest barrier causing Manufacturers to remain hesitant about terminating the exclusive position of the existing distributor and transferring to an independent third party is the prolonged application processing timeline, particularly for Class C and D medical devices, for which the Marketing Authorization Code (“MAC”) issuance may take from 1 to 2 years.
In this context, the Vietnamese Ministry of Health has opened a “highway” to support Manufacturers in this transferring. Specifically, since December 2023, Decree No. 96/2023/ND-CP has been issued and has supplemented Decree No. 98/2021/ND-CP by adding Article 32a, which allows the application of a processing priority mechanism in certain cases. These include situations where the medical device does not change its model and product code as stated in a still-valid MAC Certificate, but only the MAH changes.
Under this priority mechanism, registration applications for Class C and D medical devices are received and processed more quickly. As a result, the MAC issuance timeline is significantly shortened, with some applications taking as little as six weeks to obtain the MAC. This “highway” has removed the time-related barrier, creating momentum for Manufacturers to proactively transition to a new market management approach with an independent third party as the MAH.

📌 THAY ĐỔI CHỦ SỞ HỮU GIẤY PHÉP LƯU HÀNH TẠI VIỆT NAM: CÁCH TIẾP CẬN NHANH CHÓNG VÀ HIỆU QUẢ ✅
Gần đây, MedNovum nhận thấy nhiều Nhà sản xuất thiết bị y tế đang có “xu hướng” chỉ định một bên thứ ba độc lập nắm giữ Số lưu hành (“SLH”) để có thể linh hoạt thay đổi kênh phân phối khi cần thiết, thay vì cho phép các nhà phân phối tiếp tục giữ thế độc quyền như cách tiếp cận “truyền thống”. Tuy nhiên, rào cản lớn nhất khiến các Nhà sản xuất còn e ngại trong việc chấm dứt thế độc quyền của Nhà phân phối hiện hữu sang bên thứ ba độc lập chính là thời gian xử lý hồ sơ kéo dài, đặc biệt đối với thiết bị y tế loại C, D – thời gian cấp SLH có thể mất từ 1-2 năm.
Trong bối cảnh đó, Bộ Y tế Việt Nam đã mở một tuyến “đường cao tốc” để hỗ trợ các Nhà sản xuất trong quá trình chuyển đổi này. Cụ thể, từ tháng 12/2023, khi Nghị định 96/2023/NĐ-CP được ban hành và bổ sung Điều 32a vào Nghị định 98/2021/NĐ-CP, cho phép áp dụng cơ chế “ưu tiên xử lý” đối với một số trường hợp nhất định. Trong đó bao gồm trường hợp thiết bị y tế không thay đổi chủng loại, mã sản phẩm trên Giấy chứng nhận đăng ký lưu hành còn hiệu lực, mà chỉ thay đổi đơn vị đăng ký SLH.
Với cơ chế ưu tiên này, các hồ sơ đăng ký lưu hành thiết bị y tế loại C, D được tiếp nhận và xử lý nhanh chóng hơn. Qua đó, thời gian cấp SLH được rút ngắn đáng kể, một số hồ sơ chỉ mất từ 6 tuần để nhận được SLH. Tuyến “đường cao tốc” này đã phá bỏ rào cản thời gian, tạo động lực giúp các Nhà sản xuất chủ động chuyển đổi phương thức quản lý thị trường mới với đơn vị thứ ba độc lập nắm giữ SLH.
