🆘Visa Alert: Staying and Working Illegally in Vietnam Leads to Severe Legal Action

Police have prosecuted a man for allegedly employing 18 Bangladeshi workers who had overstayed their temporary residence permits and were working illegally at a business.

A man from HCM City has been charged with organising illegal stay in Vietnam, police in the southern province of Tây Ninh said on Friday.

Nguyễn Minh Hùng, 60, is accused of hiring workers while knowing they had overstayed their temporary residence permits in Việt Nam.

The offence was uncovered during an administrative inspection by local police at Thiên Minh Production Trading Export–Import Co Ltd in Đức Lập Commune, Tây Ninh Province.

Authorities found 18 Bangladeshi nationals working without valid visas after overstaying their temporary residence permits and failing to complete renewal procedures.

According to the initial investigation, in December 2025, Thiên Minh Company signed a contract to purchase finished wood products from a company in the neighbouring Đồng Nai Province. Defects were later found in the products after delivery, prompting the partner company to send several workers, including six Bangladeshi nationals, to carry out repairs.

During their time at Thiên Minh, the workers reportedly found the working conditions favourable and asked to continue working there. However, they were ineligible to register for temporary residence, obtain work permits or sign labour contracts as they had overstayed their permitted stay in Việt Nam.

Investigators said Hùng later recruited a total of 18 Bangladeshi workers, allegedly due to lower labour costs. Without formal labour contracts, the company also avoided obligations such as health insurance, hazardous-duty allowances and other benefits required under current regulations.

The Bangladeshi nationals have been transferred to the relevant authorities for deportation in accordance with the law.

The investigation unit under Tây Ninh Provincial Police is continuing its inquiry into the case.

📢 NOTICE REGARDING THE RELOCATION OF THE VIETNAM IMMIGRATION DEPARTMENT HEADQUARTERS 🇻🇳

Starting June 1, 2026, the Vietnam Immigration Department will officially operate at its new headquarters, located at: No. 69 Mac Thai To Street, Yen Hoa Ward, Hanoi City (Gate No. 01).

The department for receiving and processing procedures related to immigration and aviation security serving agencies, organizations, individuals, and businesses will be located at Gate No. 02 (Nguyen Quoc Tri Street, Yen Hoa Ward, Hanoi City).

To facilitate citizens and businesses, the Vietnam Immigration Department will simultaneously maintain its office for receiving, processing, and resolving administrative procedures at No. 44-46 Tran Phu Street, Ba Dinh Ward, Hanoi City, until the end of June 15, 2026.

As of June 16, 2026, all reception, processing, and resolution of procedures related to immigration management and aviation security will be conducted at the Vietnam Immigration Department, No. 69 Mac Thai To Street, Yen Hoa Ward, Hanoi City.

Starting April 15, 2026, the Vietnam Immigration Department is implementing a new regulation regarding digital entry procedures. To ensure a seamless journey, please take note of the following updates:

✈️ Scope of Application
This new mandatory regulation will first be piloted at Tan Son Nhat International Airport before being expanded to all airports nationwide.

🛂 Who Must Comply?
Foreign citizens holding valid passports and visas for entry into Vietnam.

Passengers are required to submit their personal information before their flight and present a QR code during immigration procedures.

🛡️ Why the Change?
This initiative aims to:
- Strengthen immigration management.

- Significantly reduce processing times and airport congestion.

- Move towards a fully digitized, paperless entry process.

📝 STEP-BY-STEP DECLARATION GUIDE
Passengers can complete the declaration using one of the two following methods:

✨ Pre-arrival Online Declaration: Access the official portal of the Vietnam Immigration Department. This is the only official website for submitting pre-arrival information before your flight.

✨ QR Scan at the Airport: Starting April 15, 2026, QR codes will be stationed at the Tan Son Nhat Airport arrival area. If you haven't declared in advance, you can scan these codes to complete the process upon arrival.

📢 IMPORTANT NOTICE: Vietnam Visa Extension for Foreigners Affected by Middle East Conflict
Due to the ongoing conflict in the Middle East and the closure of regional airspace, the Vietnam Ministry of Public Security has announced a supportive policy regarding temporary residence extensions for foreigners unable to return home.

🪀 If you or your employees are affected by these flight disruptions, please take note of the following guidelines:

🔹 1. Eligibility & Duration
Citizens of countries in the conflict zone: Eligible for extensions of up to 30 days per instance until flights are restored.

Citizens of other countries: If you cannot return home due to transits or flight paths through Middle Eastern airspace, you may receive a 30-day extension. You are required to purchase tickets for alternative flight routes to return home.

🔹 2. Application Process
Applications should be submitted to the Immigration Department or the Provincial/City Immigration Office.

✨ For Sponsored Individuals: The inviting/guaranteeing organization or individual must handle the procedure.

✨ For E-visa or Visa Exemption Holders: You may apply directly.
Mandatory Requirement: The application must include a formal request/recommendation from Diplomatic Mission (Embassy/Consulate) of the foreigner's country of citizenship.

🔹 3. Important Compliance
Please ensure that you complete the extension process before your current stay expires. Foreigners who fail to follow these procedures and overstay their temporary residence will be subject to administrative penalties according to Vietnamese law.

💍 Getting Married in Vietnam 2026: A Quick Guide for Expats!
The process for a Vietnamese citizen to marry a foreign citizen remains governed by the Law on Civil Status 2014 and Decree 123/2015/ND-CP.

The registration is typically handled at the Ward-level People's Committee where the Vietnamese citizen resides. Here is the breakdown of the required documents for both parties.

1. For the Vietnamese Citizen
✔️ Marriage Registration Form: A joint form filled out by both parties.

✔️ Identification: Valid Citizen ID Card (CCCD) or Passport.

✔️ Certificate of Marital Status: Issued by the People's Committee of the commune/ward where you reside, confirming you are currently single.

✔️ Medical Certificate: A specialized certificate from a competent medical organization (e.g., a psychiatric hospital or general hospital) confirming you do not have mental health issues that affect your ability to perceive or control your actions.

❣️ Special Cases:
✔️ If divorced: A copy of the court’s legally effective judgment or divorce decree.
✔️ If a civil servant/military personnel: A written confirmation from your managing agency that the marriage does not violate the regulations of that specific sector.

2. For the Foreign Citizen
✔️ Marriage Registration Form: (The same joint form mentioned above).

✔️ Passport: A copy of the passport or valid international travel document (must be notarized and translated into Vietnamese).

✔️ Certificate of Single Status: Issued by the competent authority of the foreign country, confirming the person is eligible to marry under their law. This document must be:
- Consularly legalized (unless exempt by treaty).
- Translated into Vietnamese and notarized.

✔️ Medical Certificate: Similar to the Vietnamese citizen's requirement, certifying mental health capacity. This can be obtained in Vietnam or abroad (if issued abroad, it must also be legalized and translated).

✔️ Visa/Residence Card: Proof of legal stay in Vietnam (if the foreigner is currently in the country).
