ChatGPT just "divorced" a couple before they even finished their cake. 🍰🚫

A judge in Zwolle - the Netherland just voided a marriage because the officiant let AI write the vows, forgetting the legal parts. Turns out, "I promise to stand by you" isn't the same as "I legally accept the duties of marriage."

The Lesson:
• Legal vs. Poetic: The law doesn't care about your "vibes" if the mandatory text is missing.
• AI is a Tool, Not a Lawyer: ChatGPT is great for poems, terrible for Art. 1:67 of the Dutch Civil Code.
• The "Pro" Check: Always ensure the official registrar confirms the legal wording before the ceremony.

[LEGAL UPDATE]
💥💥💥The employer must pay fine if he/she commits one of the following acts:
📌 Paying wages not on time;
📌 failing to pay or failing to pay fully salaries to employees as agreed in the labor contracts
💥The fine is up to VND100,000,000.
💥The employer is forced to pay wages in full and the interests of late payment or underpayment of wages to employees. The interests shall be calculated at the highest interest rate for non-term deposits of state-owned commercial banks announced at the time of sanction.
Under Article 16.2 Decree 28/2020/ND-CP taking effect on April 15th, 2020.

💥💥💥Scope of practice of medical practitioners is going to be in use
This is the highlight of the Circular No. 35/2019/TT-BYT regarding the scope of practice of medical practitioners.
🔥 Pursuant to this Circular, the scope of practice of medical practitioners already granted practice certificates includes:

📍- Preventive medicine physicians may examine, find and cure common diseases; provide primary care in community-based emergency situations;

📍- Commune-level physicians may participate in primary care or ordinary health care services in accordance with the Joint Circular No. 10/2015/TTLT-BYT-BNV dated May 27, 2015;

📍- Nurses, midwives and technicians may provide their respective services prescribed in the Joint Circular No. 26.

🔥 Traditional medicine doctors, practitioners, herbalists or persons owning home remedies or cures may provide services prescribed in other Circulars.

🔥 Circular No. 35/2019/TT-BYT is entering into force on March 1, 2020.

🔥🔥🔥Hanging signboards of Company

Signboards must be hung at the main gate or the front of company and must include the following information:

📍- Name of supervisory authority (if any);

📍- Name of enterprise as written in the enterprise registration certificate;

📍- Address and phone number.

The writing on a signboard must be in Vietnamese. In case Vietnamese and foreign languages are used, the writing in foreign languages must be placed under the Vietnamese part with a size not exceeding three-fourths that of the Vietnamese writing.

Either vertical or horizontal signboard may be used with the following sizes:

📍- For horizontal signboards, the maximum height is 02 meters (m) and the length shall not exceed the length of the front of the house;

📍- For vertical signboards, the maximum width is 01 meter (m) and the maximum height is 04 meters (m) but shall not exceed the height of the floor where the signboard is attached.

Signboards shall not cover emergency exits or firefighting routes; encroach on sidewalks or roads or affect traffic.

Notes for applicants for enterprise registration
📍 1. Enterprise’s name
Before registering the enterprise’s name, the applicant should check for registered names at National Business Registration Portal.
The Business Registration Office has the right to accept or reject a name in accordance with law and the decision of the Business Registration Office shall be the final.
Enterprises are prohibited to use names of regulatory bodies, the armed forces, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations as the whole or part of the enterprise’s proper name, unless otherwise permitted by the organization.
Enterprises are also prohibited to use words or symbols that contradict the history, traditions, culture of Vietnam.
📍 2. Headquarters
The address of the enterprise’s headquarter shall consist of the house number, street, commune, district, province, phone number, fax number, and email address (if any).
📍 3. Business lines
- Enterprises shall select the level 4 business lines in Vietnam Standard Industrial Classification (under Decision No. 27/2018/QD-TTg) to write on the business registration form, notification of changes in the business registration certificate or application form for conversion to the certificate of business registration.
📍 4. Charter capital
Charter capital means the total value of assets that are contributed or promised to be contributed by members/partners when establishing a limited liability company or partnership; or the total face value of shares that are sold or registered when establishing a joint-stock company.
Currently, there are no regulations on minimum charter capital for enterprise establishment, except for some cases prescribed by law that enterprises shall ensure the minimum amount of capital for operation in some specific business lines.

[Legal Update]
🔥🔥🔥Developer must pay up to 1 billion d**g in fines for late submission of documents required for application for buyers' house ownership Certificates (“Red book”)

📌 As prescribed by laws, within the maximum duration of 50 days from the date of handover of apartments to buyers, developer must file requests for Certificates issued to buyers, except as buyers file requests in person.

📌 If developers fail to submit application, fail to provide, or provide lack of, required documents for buyers to file their application in person in accordance with the abovementioned regulations, they will be fined (from VND 100,000,000 d**g to a billion d**g) and requested to take remedial actions, depending on time-length and nature of violation.

📌 This provision is under Decree No. 91/2019/ND-CP, entering into force from January 5, 2020, replacing the Decree No. 102/2014/ND-CP dated November 10, 2014.

Commercial contract - Fine and damages

💥 Fine for breach

The fine level for a breach of a contractual obligation or the aggregate fine level for more than one breach shall be agreed upon in the contract by the parties but must not exceed 8% of the value of the breached contractual obligation portion.

💥Damages

📌 Damages means a remedy whereby the breaching party pays compensation for the loss caused by a contract-breaching act to the aggrieved party.

📌 The value of damages covers the value of the material and direct loss suffered by the aggrieved party due to the breach of the breaching party and the direct profit which the aggrieved party would have earned if such breach had not been committed.
