Does Your Rental Villa Need Fire Safety Certification?

DOES YOUR RENTAL VILLA NEED A FIRE SAFETY CERTIFICATE? THE ANSWER YOU NEED BEFORE SIGNING YOUR NEXT LEASE.

Last week I received this question from a landlord in Ngũ Hành Sơn: "Helen, my villa is rented out and a tenant is asking if I have a fire safety certificate. I've never heard anyone mention this before."

Here's what you need to know:

Under Decree 136/2020/NĐ-CP and the Fire Prevention and Fighting Law (2001, amended 2013), standalone residential properties rented to five or more rooms — or accommodating ten or more people — must have an approved fire safety plan. Premium villas rented under long-term contracts, particularly when housing multiple guests, fall squarely into this legal grey zone.

What to do right now:

Step 1: Check the purpose stated on your Building Permit. If it reads "residential use," fire safety rules apply under residential regulations. If it reads "accommodation or commercial use," higher standards apply.

Step 2: Contact your local Fire Police (Cảnh sát PCCC) for guidance specific to your property type and address.

Step 3: Install the basics: the right type of fire extinguisher, emergency exit lights, an evacuation map, and schedule periodic electrical inspections.

Step 4: Add a clause to your lease stating that tenants must comply with fire safety house rules and must not use appliances that create fire or explosion hazards.

International long-term tenants now routinely ask about fire safety before signing. This is no longer an unusual request — it is the minimum standard of a professional landlord.
