📌 Kiểu dáng công nghiệp (Kiểu dáng sản phẩm) là hình dạng bên ngoài của sản phẩm của đồ vật, dụng cụ, thiết bị, phương tiện,… thuộc mọi lĩnh vực.

(ii) Lưu thông, quảng cáo, chào hàng, tàng trữ để lưu thông sản phẩm mang KDCN;

Theo quy định, để được pháp luật công nhận hợp pháp tên gọi/logo khi hoạt động kinh doanh, chủ tên gọi/logo đó cần phải thực hiện thủ tục tại Cục Sở hữu trí tuệ và chỉ có quyền khi tên gọi/logo đó được cấp “ ”

Quy trình thẩm định hồ sơ phải trải qua nhiều bước, gồm: nộp đơn, thẩm định đơn, công bố đơn, thẩm định đơn, thông báo cấp bằng (nếu đáp ứng tất cả các điều kiện bảo hộ), công bố bằng và đăng bạ vào hệ thống nhãn hiệu quốc gia.

Theo quy định thì thời gian xử lý là 12 tháng, tuy nhiên vì số lượng hồ sơ đăng ký hiện nay quá nhiều nên thời gian thực tế thường mất hơn 1.5 – 2 năm.

Do đó, để:

🔥Không bị thụ động trong việc chờ kết quả xử lý hồ sơ;
🔥Có được quyền sở hữu hợp pháp tên gọi/logo theo kế hoạch đã lên trước;
🔥Có quyền độc quyền sử dụng và ngăn cấm người khác sử dụng tên gọi/logo trùng lặp hoặc tương tự;
🔥Ngăn cản ngay được hành vi đầu cơ nhãn hiệu với dụng ý xấu ngay từ sớm;

𝟐𝟎% THẺ 𝐀𝐏𝐄𝐂 TOÀN KHỐI (19 QUỐC GIA) CẤP CHO DOANH NHÂN VIỆT NAM

Tính đến cuối năm 2017, đã có đến 𝟒𝟎.𝟎𝟎𝟎 doanh nhân Việt Nam được cấp thẻ APEC cho phép họ đi lại và thực hiện nhanh các thủ tục hải quan ( ) tại cửa khẩu 18 nước thành viên APEC. Tỷ lệ này chiếm 20% trong tổng số thẻ APEC được các nước thành viên APEC cấp cho doanh nhân của họ.

Ông 𝐃𝐚𝐯𝐢𝐝 𝐇𝐞𝐧𝐝𝐫𝐢𝐜𝐤𝐬𝐨𝐧, giám đốc truyền thông cấp cao của Ủy ban Thư ký APEC có trụ sở tại Singapore, nói rằng, thẻ doanh nhân APEC tạo điều kiện cho doanh nhân các nước thành viên APEC đi lại trong khối APEC, tiết kiệm thời gian và tiền bạc trong việc làm thủ tục xin visa và chờ đợi ở cửa khẩu. Ông nói: “Các doanh nhân Việt Nam đã tận dụng tốt cơ hội này”.

Lý giải tại sao Việt Nam chiếm một tỷ lệ cao đến 𝟐𝟎% trên tỷ lệ bình quân là 4-5% của các thành viên APEC, ông David Hendrickson nói: “Hộ chiếu Việt Nam chưa cho phép công dân Việt Nam đi lại miễn thị thực đến nhiều quốc gia khác như hộ chiếu của các nền kinh tế APEC khác. Sự hội nhập sâu của Việt Nam vào kinh tế trên thế giới sẽ thay đổi điều này trong tương lai”.

Tuy nhiên, tỷ lệ 𝟐𝟎% chưa phải là kỷ lục của khối APEC. Theo Ủy ban Thư ký APEC, tháng 3/2008, 𝐀𝐮𝐬𝐭𝐫𝐚𝐥𝐢𝐚 lập kỷ lục với tỷ lệ 𝟒𝟎% trong tổng số hơn 34.000 thẻ APEC của toàn khối, dù nước này ra những tiêu chuẩn ngặt nghèo đối với công dân nước mình khi xin cấp thẻ doanh nhân APEC. Điều kiện lúc đó đối với doanh nhân là doanh nghiệp có doanh số xuất khẩu hơn 5 triệu AUD và xếp trong danh sách Forbes 2000.
