Wow - it's been a while since I've posted here. Covid-19 made people think about getting their estates in order, and I've been busy! At last this year I've had a little bit of the Summer slow-down that I want (too nice to be in the office all the time!). I've been collecting more horror stories about failure to plan, and plans that fail. All I can say is that it never hurts to review what you have in place.

Time to update! What has changed in your family since you signed your Will or Trust? Have there been marriages, births, deaths, divorces, broken (or recovered) relationships? I can't possibly know about these unless you tell me, and I do worry about clients with plans that no longer fit the needs of their family. Schedule an update appointment today.

So you want to get in to see the lawyer but don't want to wait? Usually the larger a firm is, the longer you have to wait. There are processes, and procedures. Those do help lots of lawyers and support staff not get confused (that's good), BUT, they don't do much for your desire to take care of things now.

I concentrate on a few areas of law only, and decided when I re-opened the practice of law after being a professor for some years that I would have minimal support staff. The result? Faster service than normal, and personal attention to all the details of your case.

Meeting in the great outdoors! Why not? In this time of worry about COVID-19, why not talk on the deck or patio, where we can sit with some space between us, and plenty of fresh air? I've offered home meetings for many years, and they seem more appropriate now than ever.

LLC or corporation needed? Bad times aren't bad for every kind of business. If the place you work goes belly-up, you may need to strike out on your own, or you may have a great idea you want to be ready to launch when times get back to normal. I started work on a new LLC formation this afternoon, and the client's paperwork was filed by the State of Michigan in 3 MINUTES! Unbelievable.

Wills, Trusts, and COVID-19.

Yes, we can still start, continue, and finish work with some common sense:

1 - If you are ill, suspect you are, or are at risk with an underlying condition or fragile health - reschedule!
2 - If I have any indications of illness, I will reschedule with you.
3 - We can use phone and video and everything modern technology allows to meet "virtually" to minimize personal contact.
4 - When signing documents, bring gloves if you like. Pens are wiped down with disinfectant wipes and not reused until cleaned.
5 - We can meet at a distance: Sitting across a room, or on the deck as the weather warms, again to minimize personal contact.

Finally, if common-sense steps like these don't seem like enough, then we'll meet later. It is important to all of us and our loved ones that we stay well.

How does losing the family home sound? You'd wanted to leave it to the kids, but never could get around to visiting the lawyer. And then illness, a nursing home, help from the Medicaid program to pay the shockingly high costs.... and after death, a lien from the State of Michigan. The State wants reimbursement from your estate for what it spent. If your home goes through probate on its way to the kids, the lien attaches, and the home is most likely gone. I've seen that a few times in the last year. Make a responsible plan and save the home.
