Can a failed drug test ruin your Workers' Comp claim?

You suffered a serious injury on the job, but now your employer is demanding a drug test and threatening to deny your workers' compensation claim.

While Ohio employers can try to use a positive drug test to deny benefits, the law requires them to prove that intoxication was the direct, proximate cause of your accident. If a piece of machinery malfunctioned and crushed your hand, a failed test does not automatically erase their liability for an unsafe workplace.

If you tell your foreman you "tripped over a pallet," but the ER doctor writes down that your knee "just gave out," the adjuster will instantly use that discrepancy to claim your injury didn't happen at work. They review every single document looking for a reason to say "No."

Stick to the absolute facts. Do not guess, do not exaggerate, and do not let an adjuster put words in your mouth.

May is the busiest month for landscapers, roofers, and exterior trades preparing for summer. The pressure to complete jobs fast means safety protocols are often the first thing employers cut.

But when safety gets cut, accidents follow. And those affected deserve more than excuses after the fact.

If you fall from a ladder or a roof because your employer failed to provide adequate safety gear, you are entitled to Workers' Compensation…and potentially an additional VSSR award (Violation of a Specific Safety Requirement) that penalizes the employer for ignoring OSHA rules.

Summer construction season is going strong, so remember: for highway workers, the "office" is separated from 70mph distracted drivers by nothing but a plastic orange barrel. That’s why OTHER protections are so important!

Case in point: if highway workers are on the clock, and they get hit by civilian drivers, they aren’t limited solely to a Workers' Comp claim. They have a "Third-Party" Personal Injury claim against the driver, too.

May is National Motorcycle Safety Awareness Month, and bikes are back on the road in full force. Unfortunately, this is when we see the biggest spike in catastrophic motorcycle crashes, too.

After a long winter of only looking for cars, drivers lose their "visual reflex" for spotting bikes. But "I didn't see them" is an admission of negligence, not an excuse!

If a distracted driver turns left in front of you this May, HMMM will hold them accountable.
