As we reflect on the fireworks, backyard barbecues, and the founding of our nation this Fourth of July, we are officially staring down a pretty remarkable milestone: the 250th year of this great, chaotic, beautiful experiment in self-governance.

Two and a half centuries is a long time for a republic to keep the lights on. And while we tend to celebrate the grand concepts—liberty, freedom, independence—the experiment only keeps working if we keep our legal institutions rock-solid and stable.

Which brings us to the ultimate, unsung guardian of American freedom: Due Process.

Out-of-State Service and the Secretary of State: The "Gotcha" Factor

This keeps popping up when we receive out of state process directed to the NY SOS so let’s clear it up.

If you look at the New York Division of Corporations page on serving process, it seems delightfully simple: pay the fee, follow the rules, serve the entity. Easy, right?

Not quite. There is a glorious statutory "gotcha" hidden in the fine print.

While the site implies you can serve any entity authorized to do business in NY, the Secretary of State has strict boundaries.

New York law limits this privilege strictly to "PROCESS"
—which it defines as proceedings venued “in this state or in the federal courts sitting in, or for, this state.”

The Reality Check:
• "This State" Means New York. ONLY New York:

If your lawsuit is based anywhere else—California, Florida, Delaware, Mars—the NY SOS will gladly reject your papers.

• The Outcome: Attorneys breeze past thiscryptic phrasing every day, resulting in rejected service, aggravation, redirecting the process, possible deadline crashes and don’t forget the sudden spikes in blood pressure.

NYSPPSA convention today. I have had a fabulous but busy weekend!

Today at the NYSPPSA Convention hosted by our President Paula at her offices in Long Island was a huge success!

It was incredible seeing so many friends and colleagues this weekend.

We had some truly great conversations about the future of process service in New York, plus appreciated the insights on country-wide trends from our generous friends who traveled across state lines. Their active participation was welcome—I was genuinely happy to see them there!

On the educational front, we got an awesome refresher on the rules and pitfalls to watch for in NYS RPAPL, foreclosures, and Credit Collection cases.

My biggest takeaway, however, was Larry Y finally admitting he was around for the Magna Carta... though, naturally, he was absent the day it was actually signed.

All that hard work was balanced with some seriously good food. 🍽️
And congratulations to the new NYSPPSA board!

What a rewarding day! I had the privilege of addressing the first-year Civil Procedure class at NYU Law today, taught by the fantastic Professor Daniel Hemel.

The students were sharp, fully engaged, and we shared a ton of laughs as I recounted real-life stories from the field. Their questions were so good they kept me on my toes—in fact, one student suggested I try stand-up comedy (I'm taking that as a huge win!).
We dove deep into the true purpose of personal service, moving beyond the textbook to the trenches. The class was keenly interested in challenging cases, leading to a frank discussion about the controversial topic of sewer service and how the rules are applied in high-stakes situations. I even shared my thoughts on the often-subjective nature of traverse hearings where the process server's credibility is put on trial.
It’s always inspiring to talk to future attorneys and share the practical realities of our work. Seeing their curiosity and thoughtful analysis was truly rewarding.
Big thanks again to Professor Hemel and his brilliant class for making this such a memorable, and hilarious, afternoon!

Wishing all our amazing colleagues, friends, and valued networked businesses a truly j Wishing all our amazing colleagues, friends, and valued networked businesses a truly joyful and wonderfully vibrant 4th of July! 🇺🇸 As we gear up for a day of celebration, we hope you're all looking forward to some well-deserved relaxation, questionable grill safety, and perhaps a few dazzling fireworks (the kind that go "ooh!" and "aah!," not "oops, is that my neighbor's roof?" 😉).
It's a fantastic opportunity to appreciate the spirit of community, the warmth of summer, and maybe even finally master the art of not burning the hot dogs. And hey, while we're enjoying the festivities, it's a neat reminder of that time in 1776 when a bunch of very determined folks decided it was time to declare their independence. Pretty bold move, especially without Wi-Fi to document it all, or a legal team to draft the Declaration with endless revisions!
Whatever your plans, we hope your day is bursting with happiness, good company, and perhaps just the right amount of pie to justify loosening those belt buckles. We'll be back next week, ready to serve... and we promise our documents are less explosive than your average firecracker!

Spring has truly sprung, hasn't it? That glorious time of year when the world collectively decides to hit the reset button. Trees unfurl their tiny green flags, birds engage in enthusiastic (and often surprisingly loud) negotiations for prime real estate, and we humans... well, we emerge blinking from our winter caves, a little softer around the edges and perhaps clinging a bit too tightly to our indoor routines.
It's touted as a time of renewal, this spring thing. And you know what? Maybe it is. After months of grey skies and the distinct feeling that the sun had taken an extended vacation, there's a certain undeniable optimism in the air. Even if that optimism is just the sheer relief that we no longer have to wear seven layers to check the mail.
These are, shall we say, interesting times. Opinions seem to sprout as readily as dandelions on my lawn, often with the same level of charming persistence. But perhaps, just perhaps, this season of rebirth can remind us that different shades of green make a richer landscape. Maybe those differing viewpoints, while occasionally grating, actually add a bit of texture to our collective experience. After all, an echo chamber, no matter how cozy, isn't exactly fertile ground for new ideas.
And let's be honest, after a winter that felt a tad more isolating than usual, the simple act of bumping into someone on a crowded sidewalk (and maybe even exchanging a slightly awkward, "Oh, excuse me!") feels almost... celebratory. The hibernation is over. The great indoors is relinquishing its hold. We're venturing out, blinking in the sunlight, ready or not, to re-engage with the glorious, messy, vibrant reality of other people.
As the wise (and likely sun-deprived) writer Hal Borland once said, "Every spring is the only spring – a perpetual astonishment."
So, let's be astonished together. Let's embrace the renewal, the re-emergence, and maybe even those opinions that make us tilt our heads and go, "Hmm, interesting." After all, spring is a time for growth, and sometimes, the most unexpected seeds can blossom into something… well, something.
