Public Records Reminder: In Forhan v. Ohio House of Representatives (2025-Ohio-4336), the Court reaffirmed that draft documents can be public records under Ohio law.

If a draft reflects a public function even when created by an outside firm it may be subject to disclosure. Drafts aren’t automatically exempt. Transparency matters.

Divorce and retirement benefits can get messy.
Who gets what from a 401(k) or pension often comes down to one thing: the details in the divorce decree.
In Walsh v. Walsh (2019), the Ohio Supreme Court ruled that a trial court can’t modify a divorce decree unless both parties agree in writing even if the decree has mistakes about marriage length or payout terms.
The result? One spouse lost her share of a military pension because the decree wasn’t specific enough.
Lesson: When dividing retirement assets, make sure the order is accurate, detailed, and pre-approved by the plan administrator before finalizing the divorce.
