A few minutes before midnight last night, José was released from ICE custody. United States District Judge Jerry W. Blackwell had ruled the day before that ICE had no grounds to detain José, and he ordered José’s immediate release. With his family eagerly waiting, thirty hours later ICE finally released José.

In his order, the judge wrote the following about José (The Petitioner):

“Petitioner’s continued detention rests on a statute and an interpretation that does not apply and is unlawful. … [E]ven if [ICE] seek[s] to detain Petitioner under §1226, they have failed to produce a warrant or any other exhibit that sets forth the proper basis for Petitioner’s detention. Thus, the statutory requirements authorizing detention under §1226 are not satisfied. Petitioner is entitled to a writ of habeas corpus that grants his immediate release.”

José’s unlawful arrest was no accident by ICE. José’s unlawful arrest is not a unique situation. ICE is disobeying federal law every day in Minnesota and arresting individuals who they have no right to arrest. The rhetoric that ICE is “only arresting criminals” is not true. José is proof of that.

Many detainees in Jose’s situation are not fortunate enough to find and hire a fast-acting attorney to file a Habeas petition. We are extremely grateful to Attorneys Meg Keiser and Paschal O. Nwokocha from Nwokocha & Operana Law Offices, LLC, for their quick action to file a petition for José late on a Friday evening. ICE told José that if it hadn’t been filed that same day that he was arrested, he would have been sent to Texas the following morning and held there indefinitely.

In a late-night ruling that provides immediate relief to hundreds of thousands of Haitian nationals, U.S. District Judge Ana C. Reyes of the U.S. District Court for the District of Columbia blocked the Trump administration from ending Temporary Protected Status (TPS) for Haiti, which was set to expire at 11:59 p.m. on February 3, 2026.

The decision came in the class-action lawsuit Miot v. Trump, where plaintiffs challenged the Department of Homeland Security's (DHS) November 2025 termination notice issued by Secretary Kristi Noem. The notice had argued that conditions in Haiti had improved sufficiently and that continued TPS was contrary to U.S. national interests.

Judge Reyes granted the plaintiffs' motion for a stay, ruling that the attempted termination is "null, void, and of no legal effect" during the pendency of the litigation. The order explicitly states that the decision will not impact the validity of work authorizations (Employment Authorization Documents, or EADs) for TPS beneficiaries. Those holding TPS status remain protected from detention and deportation for the duration of the judicial stay.

In an accompanying 83-page opinion, Reyes found that plaintiffs are likely to succeed on the merits, concluding that Secretary Noem's termination decision was arbitrary and capricious under the Administrative Procedure Act. She criticized the DHS for failing to adequately address ongoing crises in Haiti, including rampant gang violence, the displacement of over 1.4 million people, economic collapse, and the absence of a functioning government, while suggesting the decision may have been influenced by improper considerations, including potential racial animus toward nonwhite immigrants.

The Trump administration is expected to appeal the decision, potentially escalating the case to higher courts or the Supreme Court. For now, USCIS and DHS websites may still display termination alerts, but the court order supersedes those, keeping TPS benefits intact pending further litigation.

Kivu Law has established an amazing network of trusted local volunteers able and willing to help Worthington area families in need of humanitarian assistance. Types of assistance that our volunteers can provide include:

- Grocery shopping
- Food or meal delivery
- Rides to/from school for students typically in the “walk zone"
- Rides to/from work or medical appointments
- Dog walking
- Laundry services for those without in-home laundry
- Other

Individuals requesting assistance can call or message Kivu Law’s WhatsApp number at 507-295-4860. Note: this is a WhatsApp number, so people must use the WhatsApp app to get through to it.

This number is monitored 7 days a week by trusted and bilingual Kivu staff. Kivu Law will receive all requests and find a volunteer to assist the family.




There are many trusted volunteers in the Worthington community willing to assist vulnerable families. Please share the number with families in need of humanitarian assistance, and Kivu Law will connect the request to local volunteers able to assist with meals, rides, food pick up, dog walks, laundry, and more.
