YOUR DEBTOR DIED. DOES THAT MEAN YOUR MONEY IS GONE?
Not necessarily.

If someone owes you money and dies before repaying the debt, you may still be able to recover what you are owed from the deceased person’s estate.

An estate may include money, houses, land, vehicles, bank accounts, investments, and other assets left behind by the deceased.
The death of a debtor does not automatically erase the debt. Depending on the applicable law, a creditor may need to make a formal claim against the deceased’s estate through the appropriate legal process.

But here is where many people get it wrong:
If the deceased left no assets or insufficient assets to cover the debt, you generally cannot simply demand payment from the deceased person’s wife, children, siblings, or other relatives merely because they are related to the deceased.

The deceased’s personal debt does not automatically become the personal debt of family members.

In simple terms: Debt does not automatically transfer to relatives.

So, before assuming that your money is gone because your debtor has died, find out whether the deceased left an estate and seek proper legal advice on how to make a claim.

⚖️ FREE LEGAL EDUCATION ON FACEBOOK: PROFESSIONAL SERVICE OR PROFESSIONAL MISCONDUCT?

A recent comment on one of my reels about my visit to the Probate Registry raised an important question: Are lawyers who educate the public about the law on Facebook bringing disgrace to the legal profession?

The comment further claimed that the new NBA President has “declared war” on so-called “Facebook lawyers.

This issue deserves a careful distinction between legal education, professional consultation, legal representation, and professional misconduct.

1️⃣ GENERAL LEGAL EDUCATION IS NOT THE SAME AS REPRESENTING A CLIENT
A lawyer who explains a general legal principle on Facebook is not automatically acting as legal counsel for every person who reads the post.
There is a significant difference between saying:
“Under Nigerian law, this is generally how a tenancy dispute may be handled.”
and saying:
“Send me your documents and I will advise you specifically on your case.”
The second situation may constitute a professional consultation and should be handled within the appropriate professional and ethical framework.

2️⃣ LAWYERS ARE ENTITLED TO PROFESSIONAL FEES
Lawyers are professionals and are entitled to charge appropriate fees for professional services, including consultations, legal research, drafting, negotiations and court representation.
However, providing general legal education to the public does not automatically mean that a lawyer is working for a specific client without payment.
Public legal education can actually serve an important purpose: helping people understand their rights, responsibilities and legal options, while encouraging them to seek professional legal assistance when their circumstances require personalised advice.

3️⃣ WHAT DO THE RULES OF PROFESSIONAL CONDUCT SAY?
Legal practitioners are subject to professional and ethical standards governing their conduct.
This includes maintaining the dignity of the legal profession and treating colleagues and members of the public with professionalism and courtesy.
Social media does not remove those responsibilities.
Lawyers should therefore be mindful of their language, conduct and interactions online. Personal insults, abusive language and unfounded attacks against fellow professionals may themselves raise ethical or legal concerns.

4️⃣ WHAT IF THE PERSON MAKING THE COMMENT IS NOT A LAWYER?
Professional conduct rules applicable to lawyers generally regulate legal practitioners, not ordinary members of the public.
However, that does not mean that social media users are free to publish false and damaging allegations about identifiable individuals or law firms without potential consequences.
Depending on the circumstances and applicable law, defamatory statements may expose the person responsible to legal action.

5️⃣ HAS THE NBA PRESIDENT “DECLARED WAR” ON FACEBOOK LAWYERS?
This is where accuracy matters.
If there is an official statement, circular, policy or directive from the NBA President specifically declaring a “war” on lawyers who educate the public on Facebook, that claim should be supported by the relevant official source.
Until such evidence is produced, it is inappropriate to present the statement as an established fact.
Regulating professional conduct is not the same thing as prohibiting lawyers from providing legitimate public legal education through social media.

6️⃣ LEGAL INFORMATION ≠ INDIVIDUAL LEGAL ADVICE ≠ LEGAL REPRESENTATION
These distinctions are extremely important.
A lawyer may provide general information about the law to educate the public while charging professional fees when an individual requires advice based on their specific facts, documents and circumstances.
Answering a general legal question on Facebook does not, by itself, necessarily create a solicitor-client relationship.

⚖️ THE BOTTOM LINE
Lawyers should be properly compensated for professional legal services.
Lawyers should also be able to educate the public about the law.
And lawyers must conduct themselves professionally, both offline and online.
These principles are not contradictory.
The legal profession has an important role in promoting public understanding of the law. Social media can be a powerful platform for responsible legal education, provided that lawyers remain within the boundaries of professional ethics and applicable law.
So, before telling every lawyer on Facebook to “stop giving free legal advice,” let us first understand the difference between legal education, legal consultation and legal representation.

⚖️ LEGAL CORNER: “I LENT SOMEONE MONEY WITH AN AGREED PROFIT—BUT I’M NOT A LICENSED MONEYLENDER. CAN I STILL SUE TO RECOVER MY MONEY?
THE SCENARIO

Imagine lending a friend a substantial amount of money to support their business.
You both agree that after six months, the borrower will return:

💰 The original amount (principal)
➕ An agreed profit or return
Six months pass, but the borrower refuses to pay.
You send a formal demand for repayment, and the response is:

“You are not a registered moneylender. You don't have a moneylending licence, so you cannot sue me or recover your money.

But is that really how the law works? 🤔
Not necessarily.

This is a common issue involving private individuals, friends, business partners, and small business transactions.

Let’s break it down. 👇
1️⃣ THE KEY ISSUE: PRINCIPAL VS. INTEREST OR PROFIT
The Principal Amount
Even where questions arise about moneylending regulations or licensing, recovering the original amount lent may be legally different from recovering interest, profit, or other financial returns.

A borrower cannot automatically assume that the absence of a moneylending licence gives them the right to simply keep someone else's money without legal consequences.

The right to recover the principal may arise from the underlying agreement, evidence of the transaction, and the applicable law.

The Interest or Profit Issue
This is where matters can become more complicated.

Many jurisdictions regulate persons who carry on the business of lending money, particularly where interest or profit is charged.

If a transaction falls within legislation governing moneylending activities, an unlicensed lender may face difficulties enforcing the interest, profit, or additional financial return agreed upon.

👉 In simple terms: Recovering the principal does not automatically mean that the agreed profit or interest will also be recoverable.

2️⃣ WAS IT A MONEYLENDING BUSINESS OR A ONE-OFF TRANSACTION?
Courts may distinguish between someone who occasionally lends money and someone who is genuinely carrying on a moneylending business.

🔹 A One-Off Private Loan
If you provided financial assistance to a friend, relative, business partner, or acquaintance on a single or occasional basis, that does not automatically mean you are operating a professional moneylending business.

🔹 A Pattern of Lending for Profit
However, the situation may be different if someone regularly lends money to multiple people for profit without complying with applicable licensing or regulatory requirements.

A court may consider factors such as:
✔️ The frequency of the transactions
✔️ The number of borrowers involved
✔️ Whether profit or interest is regularly charged
✔️ The nature and purpose of the lending
✔️ Whether the activity amounts to a commercial moneylending business

3️⃣ WHAT SHOULD YOU DO BEFORE GOING TO COURT?
Don't rush immediately into litigation.

STEP 1 — GATHER YOUR EVIDENCE 📂
Collect every available piece of evidence, including:
✅ Bank transfer receipts
✅ WhatsApp or SMS conversations
✅ Emails
✅ Voice messages
✅ Signed agreements
✅ IOUs
✅ Written acknowledgements of debt
✅ Documents showing the repayment terms
Strong evidence can make a significant difference in a debt recovery case.

STEP 2 — SEND A FORMAL LETTER OF DEMAND 📩
A proper Letter of Demand should clearly state:
• The exact principal amount owed
• The date and terms of the agreement
• The borrower's breach or default
• A reasonable deadline for payment
• Notice that legal action may follow if payment is not made

Where possible, it is advisable to seek legal assistance when preparing a formal demand.

STEP 3 — EXPLORE SETTLEMENT 🤝
Litigation can be expensive and time-consuming.
Before commencing legal proceedings, consider negotiation or a structured repayment arrangement.

Depending on the circumstances, the parties may be able to resolve the dispute through:

✔️ Alternative dispute resolution
Always ensure that any settlement agreement is properly documented.

STEP 4 — CONSIDER DEBT RECOVERY PROCEEDINGS ⚖️
If the borrower ignores your demand and continues to refuse payment, you may consider commencing appropriate legal proceedings.

Depending on the amount involved and the laws of the relevant jurisdiction, options may include:

🏛️ Small Claims procedures
🏛️ Civil debt recovery proceedings
🏛️ Other appropriate courts or dispute-resolution mechanisms

WHY YOU SHOULD THINK TWICE BEFORE DRAFTING YOUR OWN TENANCY AGREEMENT

Why should I pay a lawyer to prepare a tenancy agreement when I can simply download a template online or write one myself?
It is understandable to want to save money.

However, in property transactions, what appears to be the cheapest option today can sometimes become a very expensive legal problem tomorrow.

A LESSON FROM LAW SCHOOL
During my time at the Nigerian Law School, Lagos Campus, a lecturer in Property Law and Practice shared a practical story that has remained with me.

A landlord decided to save money by drafting his own lease agreement without consulting a lawyer.
The problem was simple—but serious.
He used legal terminology he did not fully understand.

What he intended to create as an ordinary landlord-and-tenant relationship was drafted in a way that allegedly transferred far more extensive rights in the property than he intended.
The landlord believed he had merely granted possession to a tenant.

However, the legal effect of the wording used became the subject of a prolonged dispute and years of litigation.

The lesson was clear:
In property law, the words you use can determine the rights you create.

WHAT CAN GO WRONG WITH A DIY TENANCY AGREEMENT?

1️⃣ Using the Wrong Legal Terminology
Terms such as lease, tenancy, assignment, sublease, surrender, and licence are not necessarily interchangeable.
Using the wrong terminology—or creating the wrong legal structure—can have serious legal consequences.

2️⃣ Leaving Out Important Clauses
A properly drafted agreement should address important questions such as:
• What happens if the tenant damages the property?
• Can the tenant sublet the premises?
• Who is responsible for repairs and maintenance?
• Can the landlord inspect the property?
• What happens if rent is not paid?
• How can the tenancy be terminated?
• What happens when the agreement expires?
A poorly drafted agreement can leave both parties fighting over issues that could have been clearly addressed from the beginning.

3️⃣ Including Illegal or Unenforceable Clauses
You cannot simply include any condition in an agreement and assume that a court will enforce it.
Some provisions may conflict with applicable tenancy laws, property laws, public policy, or other legal requirements.

4️⃣ Poorly Drafted Rent-Review Provisions
For example:
“Rent shall be reviewed from time to time.”
But important questions remain:
When will it be reviewed?
By how much?
What formula will be used?
Who determines the new rent?
Ambiguous rent-review provisions can easily become a source of serious disputes.

5️⃣ Confusing a Tenancy With the Transfer of Property Rights
This is particularly important.
A tenancy agreement is not automatically the same as an assignment or transfer of a landlord's interest.

The legal effect of a document depends largely on its substance, wording, applicable law, and the nature of the transaction—not simply the title written at the top of the document.
WHY SHOULD YOU INVOLVE A LAWYER?
A qualified property lawyer does far more than fill in names and rent amounts on a standard template.

A lawyer can help consider issues such as:
✅ The nature of the interest being granted
✅ The duration of the tenancy or lease
✅ The permitted use of the property
✅ Rent and rent-review provisions
✅ Repairs and maintenance obligations
✅ Subletting and assignment
✅ Default and termination provisions
✅ Notice requirements
✅ Recovery of possession
✅ Dispute-resolution mechanisms
✅ Applicable tenancy and property laws
💡 THE LESSON FOR PROPERTY OWNERS
Yes, you may be able to download a tenancy agreement template online for free.

But a template does not know your property.
It does not understand your specific transaction.
It does not assess the laws applicable in your jurisdiction.

And it certainly does not identify every legal risk that may arise between you and your tenant.
You are not paying a lawyer merely to put words on paper.

You are paying for legal knowledge, interpretation, risk assessment, and the protection of your interests.

The small amount saved by avoiding professional legal advice today could potentially become a far greater expense in legal disputes tomorrow.
Before signing a tenancy or lease agreement, consider having it drafted or reviewed by a qualified legal practitioner in your jurisdiction.
Prevention is often far cheaper than litigation.

You succeed in your case.

The court grants an Order of Mandamus, directing the relevant agency or public officer to carry out that statutory duty.

But then, the unexpected happens:
The officer refuses to comply with the court order.
What happens next?

A valid and subsisting court order is not optional. It is expected to be obeyed unless it has been lawfully stayed, varied, discharged, or set aside by a competent court.

Deliberately ignoring a court order may have serious legal consequences, including the possibility of contempt of court proceedings, depending on the laws and procedures of the relevant jurisdiction.

The successful party may take the appropriate legal steps to enforce compliance and, where the necessary legal requirements are satisfied, initiate proceedings against the person responsible for the disobedience.

However, not every failure to comply with a court order automatically amounts to contempt.

📚 THE KEY LESSON
Mandamus is a legal remedy used to compel the performance of a public duty where the law requires action.

And where a person deliberately refuses to obey a valid and enforceable court order, legal mechanisms may be available to secure compliance, including contempt proceedings where the applicable legal requirements are met.

A court order is not a suggestion.

Knowing your rights is important.

The jury in the Lindsay Clancy trial has been deliberating for nearly five hours, and a new development has drawn attention inside the courtroom.
