Not All Probate Cases Are the Same

Texas law provides several ways to handle a loved one’s estate:

▪️ Independent Administration – The executor or administrator handles most estate matters with limited court supervision.

▪️ Dependent Administration – The court closely supervises the estate, and approval may be required before property is sold or money is distributed.

▪️ Muniment of Title – When there is a valid will and no need for an administration, the will may be used to transfer property without appointing an executor.

▪️ Small Estate Affidavit – Certain smaller estates without a will may qualify for a simplified procedure.

▪️ Determination of Heirship – When someone dies without a will, the court may determine who the lawful heirs are.

The right procedure depends on the will, the estate’s debts and assets, and the family’s circumstances. Choosing the correct option can save time, expense, and unnecessary court involvement.

$418,750.00 Settlement for Victims of Car Wreck in Construction Zone

Our firm recently helped secure a $418,750 settlement for our clients who were injured in a car wreck within a construction zone. In addition to a negligent driver, we believed the poor design of the construction zone played a part in this accident allowing us to pursue multiple defendants in a lawsuit.

Today was a GOOD day!

CPS was ordered to return a child to my client immediately. My clients ex had bad CPS allegations against her. My client felt left in the dark about what these allegations were, so we filed for custody. Despite a pending custody case, and without any real investigation into my client, CPS removed the child and placed in foster care. We filed a motion challenging the removal and proved CPS didn’t follow procedure and the removal was without merit against my client.

The court ordered an immediate return to my client and we filed a motion to protect child from the other parent pending future court hearings. Seeing the child cling to my client’s neck after court was amazing, but sad that the child had to go through an unnecessary CPS removal.

Who you choose to represent you makes a difference.

Our clients were injured in car wreck and were found at-fault. The insurance company thought they had a slam dunk case against our clients and threatened to sue them for property damage. However, we believed our clients' story and our investigation proved they were right. We filed a lawsuit against the truly negligent party and not only did the insurance release the property damage claim, but they also paid our clients for their injuries.

Recent result from one of our firm's cases: Our client hired a contractor to pour a new driveway. Proper techniques were not followed, resulting in a very poor product, and the contractor would not fix the situation. Every attempt was made to settle this matter without a lawsuit, but finally, on the eve of trial we settled for approximately the cost of a brand new driveway. Happy for our clients!
