SCORE ONE FOR HIGH PERFORMANCE MOTORCYCLE 2-UP RIDING AT TRACK DAY AND ROADRACING EVENTS.

Following a trial that spanned 20 days, a California jury determined that the practice of providing 2-up rides to participants was not grossly negligent. This verdict arose out of a lawsuit filed by a female motorcyclist who sought $7 million dollars for multiple orthopedic injuries and alleged traumatic brain injury as a result of crashing during a 2-up ride at a Northern California racetrack. The lawsuit was allowed to proceed to trial because the court had determined beforehand that the waiver and release signed by the motorcyclist barred only claims for ordinary negligence, not “gross negligence” as was alleged in the case. This successful trial outcome provides important validation for both the insurers and race tracks, track day organizations, and racing associations that 2-up riding is an acceptable practice in the industry and is insurable.
