Today I had the opportunity to visit my daughter’s 4th grade class and give a presentation about the United States Constitution and our government. It was a special experience because I still remember my own father coming into my elementary school class years ago to give a very similar presentation. Seeing that same tradition continue with the next generation was incredibly meaningful. The tradition lives on.

Living with an autoimmune disease can mean battling symptoms people cannot see — chronic fatigue, pain, brain fog, and flare-ups that make working impossible. If your condition is preventing you from maintaining full-time employment, you may qualify for Social Security Disability benefits.

At FBR Law, we help individuals navigate the SSD process and fight for the benefits they deserve.

Veterans often hear “100% VA rating” and “TDIU” and think they mean the same thing—they don’t.

A 100% rating from the U.S. Department of Veterans Affairs means your service-connected conditions are severe enough, under VA rules, to equal total disability. This is based on your medical ratings—not whether you can work. In most cases, you can still work and keep your benefits.

TDIU (Total Disability based on Individual Unemployability) pays at the 100% rate, but it’s based on something different. It means your service-connected conditions prevent you from maintaining steady, gainful employment—even if your combined rating is less than 100%.

The simplest way to think about it:

100% rating = how severe your conditions are
TDIU = whether you can work because of those conditions

One key difference—TDIU comes with income limits. If you’re working and earning above a certain level, you can lose it. A 100% rating generally does not have that restriction.

Bottom line: same pay, different path.

If your Social Security Disability benefits stopped because you returned to work—but you can no longer continue working due to your medical condition—you may qualify for Expedited Reinstatement (EXR).

EXR allows you to restart your benefits without filing a new application, as long as:
• Your benefits ended within the last 5 years
• You are unable to perform substantial gainful activity
• Your current condition is the same as (or related to) your original disability

For Social Security Disability claims, objective medical evidence isn’t optional — it’s critical.

The Social Security Administration evaluates claims based on documented medical findings, not just reported symptoms.

Strong objective evidence includes:
✔️ MRI/CT scans
✔️ X-rays
✔️ EMG/nerve studies
✔️ Measurable exam findings (ROM deficits, strength loss, positive tests)
✔️ Consistent treatment records

A diagnosis alone isn’t enough — the record must demonstrate functional limitations that prevent sustained work.

Stronger records = stronger case.

💡 Why Veterans Receiving TDIU Should Strongly Consider Applying for SSDI

Many veterans who are granted Total Disability based on Individual Unemployability (TDIU) assume that their financial benefits stop there—but that’s not always the best strategy.

Here’s why applying for Social Security Disability Insurance (SSDI) can be a smart move:

✅ Additional Monthly Income
TDIU pays at the 100% VA rate, but SSDI is a separate federal benefit. If approved, you can receive both—significantly increasing your overall monthly compensation.

✅ Different Legal Standards
The VA and Social Security evaluate disability differently. A grant of TDIU—especially based on inability to work—can be strong supporting evidence in an SSDI claim.

✅ Medical Coverage Expansion
Approval for SSDI can lead to Medicare eligibility (typically after 24 months), giving you additional healthcare options beyond VA treatment.

✅ Protection & Flexibility
Having both VA and SSDI benefits provides a layer of financial security and flexibility for you and your family.

⚖️ Bottom line:
If the VA has already determined you cannot maintain substantially gainful employment, it may be worth pursuing SSDI benefits as well.

One of the biggest factors in winning a disability case is consistent, ongoing treatment.

Why? Because the record tells the story.

Medical evidence isn’t just about what you’ve been diagnosed with—it’s about how your condition impacts you over time. Regular treatment creates a clear timeline of symptoms, limitations, and progression. Gaps in care can be used to argue that your condition isn’t as severe as claimed.

Consistent treatment helps establish:• Credibility• Severity of symptoms• Functional limitations• Compliance with medical advice

Even if you feel like treatment isn’t helping, documenting your condition still matters. Every visit strengthens your case.

Bottom line: If you’re pursuing disability benefits, don’t disappear from treatment—the paper trail is often what wins the case.
