Reminder of new laws taking effect July 1 or later

Attention Virginia Residents and those who frequent Virginia...here are a few of the top 10 new laws that will go into effect on July 1, 2020:

Here are my top 7 to highlight, but click the link to read all ten as well as the many other changes that will take place on Wednesday:

1. Possession of marijuana is still illegal in Virginia, but possession of a small amount is no longer criminal. Possession of 1 oz. or less of marijuana is now subject to no more than a $25 civil fine.

2. Failure to report a lost or stolen firearm can result in a summons and a fine of no more than $250.

3. It is a class 6 felony (1 to 5 years imprisonment) for a person who is the subject of a protective order to possess a firearm while the protective order is in effect.

4. The threshold amount to charge a person with grand larceny has been raised from $500 to $1,000.

5. Custodial interrogation of a juvenile can take place only after law enforcement has attempted to notify the parent or guardian that the juvenile is in custody, except in limited circumstances.

6. The charge of disorderly conduct cannot be brought against any student at an el- ementary or secondary school if the behavior occurred on school property, on a school bus or during a school sponsored activity.

7. Previously, it was assumed that it was reckless driving if you drove more than 80 mph on the highway. That speed has now been increased to 85 mph.

Atlanta Police officer who killed Rayshard Brooks charged with felony murder

Both Officers were charged. The shooting officer has 11 charges and no bond. The other Officer turned State Witness with charges as well and a $50,000. Bond. In most cases he will be out with $5,000.

Four Minneapolis police officers fired after death of unarmed man George Floyd

WOW...The Officer's knee was in this man's neck for at least 7 minutes?? Glad they were fired, but the officer's need to be charged with Murder! Its frustrating for Officers to act as the Judge and Jury! If you believe one committed a crime charge him, arrest, and/or even take him into custody...but do not allow him to die unarmed and in handcuffs. What happens to the vow to serve and protect? How sad and its on video...we have Courts for a reason...and there is a valid presumption of innocent until proven guilty that so many tend to forget...truly wonder what would have been the outcome if the encounter was not caught on video...prayers up for this man's family and peers....

A mandatory order will go into effect on June 1, 2020 requiring all persons entering the Prince William County courthouse to wear face coverings that cover their nose and mouth AT ALL TIMES. As recommended by the Virginia Department of Health, this order will not apply to children under the age of two, or individuals who have difficulty breathing, or who cannot remove a face covering without help, or have other medical issues that make the wearing of a face covering unsafe.

Hi Everyone and we hope each of you are staying safe. Attached is the latest Virginia Supreme Court Order from May 2020. Please pay special attention to General District Court and Juvenile & Domestic Relations Court. While some cases will still go forward as they are currently (Family/Domestic Abuse, incarcerated Defendants, etc.) but many (Civil, traffic, misdemeanors, etc.) will be continued. Each locality are handling continuances differently, so please contact the clerk of that specific Court and/or view the website to check your case status. It appears Courts outside of hearing certain matters will remain closed through June 7, 2020.

Paragraph (4) of the Va. Supreme Court's May 6 order seems to give the trial courts that option https://t.co/XA1n6L80HO?ssr=true . Beware as pro se defendants may mistakenly assume that this Supreme Court order automatically continues your case and that is not necessarily true. Please follow up on your case and check the status. Most Court clerks offices are open for you to call during the morning hours with a very limited staff, so please be patient.

While in the midst of the pandemic decisions are still being made by our United States Supreme Court:

In the case of: Kansas v. Glover (18-556) – April 6, 2020

The question presented: is whether, for purposes of an investigative stop under the Fourth Amendment, it is reasonable for an officer to suspect that the registered owner of a vehicle is the one driving the vehicle absent any information to the contrary.

Held: When the officer lacks information negating an inference that the owner is driving the vehicle, an investigative traffic stop made after running a vehicle’s license plate and learning that the registered owner’s driver’s license has been revoked is reasonable under the Fourth Amendment. Pp. 3–10.

JUSTICES: THOMAS, J., delivered the opinion of the Court, in which ROBERTS, C. J., and GINSBURG, BREYER, ALITO, KAGAN, GORSUCH, and KAVANAUGH, JJ., joined. KAGAN, J., filed a concurring opinion, in which GINSBURG, J., joined. SOTOMAYOR, J., filed a dissenting opinion.

All district and circuit courts of the Commonwealth of Virginia, pursuant to Va. Code § 17.1-330, this Order shall be in effect from today, Monday, March 16, to Monday, April 6,
2020, and it is hereby ORDERED that NON-ESSENTIAL, NON-EMERGENCY court
proceedings in all circuit and district courts be and hereby are SUSPENDED and all circuit and district courts shall implement the following measures absent a
specific exception to:
1. Continue all civil, traffic and criminal matters, including jury trials, subject to a defendant’s
right to a speedy trial, with the exception of emergency matters, including but not limited to,
quarantine or isolation matters, arraignments, bail reviews, protective order cases, emergency
child custody or protection cases, and civil commitment hearings. Judges may exercise their
discretion with regard to proceeding with ongoing jury trials, and in cases where the defendant is
incarcerated. Please check the status of your case before attempting to come to Court or to not appear in Court.

In light of Governor Northam’s prohibition of gatherings in excess of 100 individuals, the Prince William County General District Court will be CLOSED the week of 3/16-3/20. On 3/20, the General District Court will send a new notice regarding the status of Court beyond 3/20. The Court encourages Counsel to file bond motions for all in-jail clients who might be eligible for bond.

Prenuptial agreements? Good or Bad? Our response is they are personal and should be kept between the parties and the lawyers who write them 😉. Ideally you would not need to use it. However, they do protect your assets and retirement accounts acquired prior to the marriage and in some instances during the marriage. Additionally, the agreement avoids a protracted litigation of having the Court determine the division of assets & retirement accounts. It's really best to marry someone with whom you are equally yoked and adhere to the vows til death do you part. The question often arises as to when you are stopped and questioned about drinking & driving ("DUI/DWI") whether or not you can refuse the breathalyzer and the Standard Field Sobriety Tests ("SFSTs"). The answer is that it is illegal in Virginia to "Unreasonably" Refuse. However, it is important to note that "Generally" the Preliminary Breathalyzer Test ("PBT") the one used outside of the police station is "Usually" not admissible in Court. Keeping this in mind remember this is a 3-day weekend and Courts are closed on Monday. Please make wise decisions and do NOT attempt to argue your defenses on the street...its best retain an Attorney and handle it in Court.
