⚖️ Can a Class Action Be Decertified After It Has Been Approved?
Class certification is an important milestone, but it does not guarantee that a case will remain a class action until the end. As litigation develops, new evidence or changes in the claims may affect whether the case still qualifies.
🔎 A court may reconsider certification when:
✔️ New evidence changes the case
✔️ The claims no longer share common issues
✔️ Individual questions become more significant
✔️ Classwide damages become difficult to establish
In New Jersey, a court may modify or decertify a class if the requirements for class treatment are no longer satisfied.
