This happened in Charlotte, but using Virginia as an example:

- the BMW driver’s liability insurance pays for the three cars he hit and for anyone hurt in them.
- If he only carries the state minimum, that’s $25,000 total for all three cars, and $50,000 per person and $100,000 total for everyone injured.
- Anything over that, he can be held personally responsible for.

His own BMW isn’t covered by liability at all. Only collision coverage pays for it, if he bought it. Virginia also treats intentionally driving a car in a way it isn’t meant to be driven, as reckless driving (Va. Code § 46.2-865). A conviction can cost him his license for up to 6 months.

A black Corvette swerves to avoid a white SUV that merges into its lane without checking first. The Corvette makes contact trying to get out of the way.

Here’s who’s at fault:

The SUV. Virginia law (Va. Code § 46.2-804) requires a driver to confirm a lane is clear before moving into it. Merging without checking is exactly the violation this statute covers.

The Corvette’s swerve doesn’t change that. Reacting to someone else’s sudden merge isn’t judged the same way as causing it.
