A few days ago, a stenographer at a deposition mentioned she had transcribed depositions in the Bertucci case years ago. In that case, Katherine Brodsky, aged 17, died in 1986 from eating chili that unknowingly had peanut butter added. Here is a link to the story. This was one of the first allergy

The parties in the Texas v. Becerra case about Section 504 filed a status report on Feb 19. Their report clarifies that they are not challenging Section 504 itself as unconstitutional. Instead, they clarified that their argument is that the Final Rule regarding transgender people is unconstitutional. So it looks like we have some more hope going forward. Hopefully, they mean what they say and that it was just a faulty wording in their complaint.
From the status brief:

"Plaintiffs clarify that they have never moved—and do not plan to move—the Court to declare or enjoin Section 504 of the Rehabilitation Act, 29 U.S.C. § 794, as unconstitutional on its
face. Plaintiffs have not sought and do not seek to enjoin the disbursement of funds from the Department on the basis that the statute is unconstitutional."

Francoeur Law is excited to announce our new associate, Daravichea (Chea) Lim!

He earned his J.D. from New England Law in Boston and recently passed the July 2024 Bar Exam, becoming licensed to practice in Massachusetts, with admission pending in New York. Before pursuing law, he earned an undergraduate degree in Electrical Engineering and a Master’s in Engineering Management at Northeastern University.

During law school, he has gained experiences in moot court and litigation, interned as corporate counsel, and worked at a patent prosecution firm.

Outside of work, he’s an avid skier and hiker, always looking for the next adventure.

Today is a big day in food allergy law! I finally got the final judgment in a case I litigated last year against Boloco for adding peanut sauce to a burrito served to a child with peanut allergy. The judge found that it was a violation of Mass Consumer Protection law and that Boloco acted in an unfair or deceptive way. The judge allowed punitive damages, awarding attorneys' fees and costs. Plus, the judge ruled that interest on the judgment starts to occur at the time of the anaphylaxis rather than the time the suit was filed. In my case, this adds another year's worth of interest on the verdict. This is the first case of its kind and hopefully will set precedent going forward.
