I am getting a tremendous amount of inquiries concerning the upcoming registration deadline, evidently caused by a conflict between my opinion letter to GOAL and another lawyer's incorrect video which is circulating.

I advise anyone with concerns (and the other lawyer) to review the EOPS guidance.

A recent very nice review was left for me on Avvo. The situation was unusual. My client exercised self defense and it seemed the state police could see it was probably justified but, as they often do, wanted to leave it up to the courts. So they requested a summons to both parties to a clerk magistrate hearing. The clerk however issued a complaint against both parties for felonies. Now, the general rule that all lawyers and judges know is that there is no right to a hearing for a felony (unlike a misdemeanor for which you aren't arrested which usually requires one.) But there is a lesser known special provision for when the police request a hearing on a felony which provides that the court must conduct a hearing. After much explaining, and citing the guide issued by the trial court, the case was dismissed. Recently, the client's firearm license was also restored too.

Recently I was able to get a client relieved of a 38 year old felony delinquency. The approach to juvenile justice has changed so much over the past few decades that there is now an opportunity to re-evaluate the treatment of at risk young folks.

I have had success vacating old convictions and delinquencies. The oldest was an assault and battery from 1967 for a soldier that returned from service in Vietnam that had a fight in a bar.

Today for the third time I have convinced a Court to expunge an arrest following the allowance of a motion to dismiss for lack of probable cause on the grounds of "mistake" by court officials or law enforcement pursuant to Ch. 276 Section 100K. Glad to report all charges dismissed after my motion to suppress was allowed in a case I've been fighting for a nice guy. Like many people he was unaware of Mass gun laws when he moved in with his fiancé and brought a number of rifles and magazines. Rhode Island Environmental Police investigating a hunting violation got Massachusetts counterparts to obtain a search warrant six months after the incident. Due to staleness, the search was suppressed.

This was an interesting situation. I was hired to try to vacate a probation violation from awhile ago. The client tried unsuccessfully to get the charge expunged last year and when I dug into the case I could see he should not have been denied expungement. So I filed a motion and had to explain to the judge why she was wrong. Turned out great and he left me a nice review:

"Worth every red cent. I was recommended to hire Mr Neil and I see why. He was very precise and calculated. He’s very knowledgeable and experienced. I would recommend him to anyone that wants true representation."
