Buc-ee’s vs. Everyone With a Cartoon Animal Logo
Buc-ee’s is on a beaver-branding crusade, suing Beaver’s Mini Mart, Mickey’s (a moose, somehow too close to a beaver), Nomnom, and Teddy’s Market — who clapped back, calling Buc-ee’s a “trademark bully.” Some rivals settled; Teddy’s is digging in. Moral of the story: don’t name your gas station mascot anything with a hat and a big smile if there’s a 175-foot beaver empire nearby.

Van Leeuwen v. Rebel Creamery: The $23.8M Pastel Problem
A judge ruled Rebel Creamery copied Van Leeuwen’s minimalist pastel pints right down to the cursive font — to the tune of $23.8 million in disgorged profits. Rebel has since filed for bankruptcy while appealing. Turns out “inspired by” and “identical packaging” are not the same legal defense, and courts noticed.

Netflix’s KPop Demon Hunters Meets an Actual Demon Hunter
Christian metal band Demon Hunter is suing Netflix, claiming its blockbuster “KPop Demon Hunters” — now headed to arenas — is causing real confusion (a fan reportedly bought $500 tickets to the wrong “Demon Hunters” show). Netflix says the claims are “without merit.” Proof that even an Oscar-winning franchise can’t outrun 25 years of trademark rights and a very unlucky name overlap.

I am frequently asked if artificial intelligence will replace attorneys. My perspective is that this is unlikely to occur in the foreseeable future.

When utilized as a tool, AI is highly effective at completing tasks quickly and efficiently. However, like any tool, it requires diligent human supervision to avoid potentially catastrophic consequences. It is an established fact that AI can generate inaccurate information, and several attorneys have already faced disciplinary action from state bar associations due to the unsupervised use of these technologies.

Most state bar associations have begun regulating the use of AI within the legal profession. Notably, there is also pending litigation regarding the unauthorized practice of law by AI entities.

To maintain the integrity of the legal profession, attorneys must ensure that we use AI tools judiciously and with proper oversight.
