🚨 Cybersecurity Awareness Month: Protect Your Senior Loved Ones

October is Cybersecurity Awareness Month, making it an important time to talk about a growing concern for seniors and family caregivers: financial exploitation and online scams.

Scammers often use urgency, fear, trust, and isolation to convince victims to hand over money or access to their accounts.

Watch for these common scams:

πŸ’» Tech Support Scams
Fraudsters pretend your computer or account has been compromised and demand remote access, payments, or gift cards.

πŸ’” Romance Scams
Scammers build long-term online relationships and eventually create an urgent financial situation involving money transfers or other payments.

πŸ›‘οΈ Legal Planning Can Help
A properly drafted Durable Power of Attorney can give a trusted person authority to help manage financial matters when appropriate. Depending on the circumstances, families can also use account alerts, credit monitoring, and other safeguards to help detect suspicious activity.

πŸ₯ Medicare vs. Long-Term Care: Know the Difference

β€œMedicare does NOT pay for long-term care.” - Attorney Tom Shanahan

One of the most common and costly misunderstandings in elder law is assuming Medicare will cover ongoing nursing home or custodial care.

Here’s what families should know:

1️⃣ Medicare may cover certain short-term skilled care and rehabilitation when eligibility requirements are met, but generally does not cover ongoing custodial care.

2️⃣ Long-term care can be expensive, potentially placing significant financial pressure on families who are unprepared.

3️⃣ Medicaid planning may offer options for eligible individuals seeking help with long-term care costs while protecting important family assets.

🍁 Hello, October!

As we welcome fall, Thomas D. Shanahan, P.A. extends our deepest gratitude to the unsung pillars of our communities: family caregivers.

Across Florida and New York, millions of family members provide daily care and support to aging parents, spouses, and loved ones. Their dedication helps older adults remain safely in their own homes, preserve their independence, and maintain their dignity.

But caregiving can also bring significant emotional, financial, and legal challenges.

Having the right legal protections in place can help caregivers navigate these responsibilities with greater confidence, including:

πŸ“‹ Durable Powers of Attorney to help manage financial and legal matters
πŸ₯ Healthcare Surrogates to support medical decision-making
🏑 Homestead protections to help safeguard the family home

To every caregiver showing up for a loved one this fall: we see you, we appreciate you, and we honor your dedication.

πŸ₯ Medicare vs. Medicaid: Do you know the difference?

They sound almost identical, but when it comes to long-term care, nursing home costs, and protecting your family's assets, Medicare and Medicaid serve very different purposes.

Understanding the difference before a health crisis happens can make a major difference for your family.

πŸ”΅ MEDICARE
Medicare is federal health insurance primarily for people age 65 and older, as well as certain younger people with disabilities or specific conditions. It helps cover hospital care, doctor services, outpatient care, and certain skilled or medical services. However, Medicare generally does not pay for long-term custodial care.

🟒 MEDICAID
Medicaid is a joint federal and state program with eligibility based on financial and other requirements. Depending on the state and circumstances, Medicaid can help cover services that Medicare generally does not, including nursing home care and certain home and community-based long-term care services.

⚠️ Why does this matter?

Long-term care can create significant financial pressure for families. Medicaid eligibility involves specific rules concerning income, assets, transfers, residency, and other factors, and the rules can differ between Florida and New York.

❌ Don't wait until a medical crisis to start planning.
βœ… Understand your options before you need them.
βœ… Review your estate plan and asset protection strategy.
βœ… Get professional guidance before transferring or retitling assets.

🍁 October is National Estate Planning Awareness Month, making it the perfect time to take control of your legal future.

Estate planning isn't just about what happens after you're gone. It's about protecting your choices, your family, and everything you've built while you're still here.

Ask yourself:

β€’ Who can manage your finances if you become incapacitated?
β€’ Who can make critical healthcare decisions for you?
β€’ Who will care for your children if you're unable to?
β€’ How much court involvement could your family face?

Without proper planning, state default laws may determine these answers for you.

Throughout October, Thomas D. Shanahan, P.A. will share practical guidance on estate planning, multi-state considerations, probate, and strategies to help protect your family's future across South Florida and NYC.
