When a spouse passes away, joint bank accounts typically transfer to the surviving spouse without probate, but individually held accounts freeze until the estate is settled. 💡

Social Security benefits change as well. You generally keep the higher of the two payments but lose the lower one entirely. Tax filing status shifts, beneficiary designations on retirement accounts and life insurance activate immediately, and any debts held solely in the deceased spouse's name go through the estate before creditors can collect.

Most surviving spouses are navigating all of this while grieving, which is exactly why having an estate plan in place beforehand matters so much.

In North Carolina, a standard will must be signed by the testator and witnessed by at least two people who are present at the same time, and those witnesses generally should not be beneficiaries.

Holographic wills, which are entirely handwritten and signed by the testator, are also recognized under NC law but come with their own requirements.

The specifics matter, and a will that doesn't meet them may not hold up in court when it needs to most.

A will tells the court how you want your assets distributed after you pass. 📋 An estate plan does that and much more. It can include powers of attorney for finances and healthcare, advance directives, beneficiary designations, and, in some cases, a trust can help your family avoid probate entirely. Relying on a will alone leaves a lot of important decisions unaddressed.
