Update: Changes are coming regarding how USCIS and USDOS will determine whether someone might be “likely to become a public charge” giving officers greater discretion to deny green cards based on this ground of inadmissibility

Not-so-brief summary of what’s the deal with DACA and the ongoing litigation 🦋

Scams against the immigrant community are becoming worse with the advancement of technology and the difficult times we are facing with the current administration. Our office has received various calls from people who have been solicited via Whatsapp by fraudsters claiming to be "attorney Vanessa Gonzalez" but using the image and license number of another actual attorney (also named Vanessa Gonzalez) with an office in California. We have assisted them in navigating how to report these crimes to the proper authorities, but that may not undo the damage caused to their actual cases or money they have lost. There also are many non-attorneys offering immigration services, while not being licensed to practice law (normally referred to as notarios, but some posing as actual attorneys). Make sure to confirm that your attorney is an actual licensed attorney to practice (ask what state they are licensed in an you can check to see if they are in the attorney directory and in good standing. NC's is here: https://portal.ncbar.gov/verification/search.aspx A list of current BIA accredited reps (who may practice immigration but must be supervised by a licensed attorney) is here: https://www.justice.gov/eoir/media/1398081/dl?inline ) Legitimate law firms will not solicit you by randomly reaching out over social media or Whatsapp. It is against the rules of our licenses to solicit directly, clients must come to us. Most law firms will only accept payment in person at their office or via secure payment sites like LawPay (not via Cashapp, Venmo, etc.) Stay informed, and be careful!

“Can I travel?” This is a question we get every day, and it is a loaded one. It often is a joke that you can ask a lawyer anything and they’ll respond “it depends,” but right now - it really depends. When the Gov is not playing by the rules and reports of folx in lawful status being detained (traveling domestically or re-entering the US) sadly the safe (but not convenient) route often is to sit still. Here are some advisories from AILA on things to consider about traveling based on status type to have and share

The current admin sunsets funding that allowed a network of experienced immigration nonprofits to represent minors in removal, to then award a $150M contract to a private corporate firm w/o immigration experience as a practice area (reports show immigration law was not listed previously as a practice/experience area and currently only 2/25 attorneys at said firm even list immigration experience) and where top attorneys have MAGA ties.

Legal aid groups are raising concerns after the Trump administration awarded a $150 million contract to a small Texas law firm with limited experience in immigration law.
