Tired of Seeing Gang-Bangers and Other Criminals with Guns?

So was I. As a North Carolina Senator, I was able to increase the penalty for second offenses of carrying concealed fi****ms. Wilmington Police Chief Ralph Evangelous requested help and I was happy to oblige him.

This law increased the penalty for a second or subsequent offense of carrying a concealed weapon that is a firearm from a Class I felony to a Class H felony. The change makes it easier for the State to seek jail time for offenders and get them off the street.

To make sure that the gun rights of law-abiding citizens was NOT impacted, this section also clarifies that a concealed carry permit holder cannot be charged under this statute for simply not having their permit on their person.

To clarify for all knee-jerk liberals and anti-gun Chicken Littles: Criminals with guns – NOT good. Law-abiding citizens with guns – GOOD.

What does "INNOCENT UNTIL PROVEN GUILTY" mean? Under the American system of justice, you are innocent until PROVEN guilty. This means that the State must PROVE that you are guilty "beyond a reasonable doubt" of the criminal charges filed against you. It is the highest standard of proof required in the law. Many people who MAY have committed a crime go free because the State cannot prove the charge beyond a reasonable doubt. You are not guilty simply because you were arrested and charged with a crime.

New Pro-Gun Laws in North Carolina

With gun-friendly legislators in charge of the North Carolina House and Senate, many amendments to the State's fi****ms laws have occurred over the several years. Below is a list of the more interesting ones.

The legal changes have done the following:

-- Authorizes a concealed carry permit holder to have a handgun in a locked vehicle on educational property.
-- Authorizes hunting with a silencer.
-- Conforms the definition of "qualified retired law enforcement officer" with federal law.
-- Creates the status offense of armed habitual felon.
-- Clarifies that a concealed carry permit holder may have a handgun in a locked vehicle in a parking lot owned or leased by State government.
-- Authorizes certain employees who reside on the campus of a college, university, or boarding school to have a handgun on the premises of their residence.
-- Authorizes a concealed carry permit holder to have a handgun at assemblies where admission is charged, establishments that serve alcohol, and at parades and funeral processions, unless a notice is posted prohibiting it.

What do you do if your car is TOTALED and the insurance adjuster will NOT offer a FAIR price for your destroyed vehicle. What do you do? Hire a lawyer and file a lawsuit? Not so fast... Thank goodness that the North Carolina law comes to your rescue in a BIG way!!!

Here's How:

If you and the adjuster are initially unable to reach an agreement as to Fair Market Value (FMV) then the adjuster is required to base any further settlement offer not only on published regional average values of similar vehicles but also on the value of the vehicle in the local market. Local FMV must be determined by using either the local market price of a comparable vehicle or, if no comparable vehicle can be found, quotations from at least two qualified dealers within the local market area. If your vehicle was in better than average condition prior to the collision the adjuster is required to give due consideration to this fact in arriving at value. 11 NCAC 4.0418(1).

You should require from the adjuster that a written statement accompany the total loss payment which statement should include estimates, evaluations and deductions used in calculating the payment as well as stating the source of these values. 11 NCAC 4.0418(4).
