Yes. It is real . . .

When you use professional mediation with an experienced, trained mediator for the process. This process in fact ensures that everything and anything that gets discussed, revealed, presented and resolved remains private and confidential. So a lot of the usual external drama can be kept to a minimum or even prevented.

Also, engaging in mediation is risk free as nothing discussed or created in mediation gets turned over to the courts in the rare case mediation is unsuccessful. The mediator-client(s) privilege is real!!

A divorce, regardless whether it’s amicable or contentious, should focus on the outcome and the future after the divorce is final and new, separate lives begin. With professional mediation this approach for a holistic divorce is absolutely achievable. The holistic divorce focuses on what’s truly in the best interest of the children, regardless their ages, focus on keeping FICO scores intact and finances manageable for both sides, be customizable for current and future careers and self-employment, and by design be transparent and grounded in reality.

Holistic Divorce?
Yes. Absolutely. Also quite certain, there is life after the divorce. So don’t ruin it with nasty, never ending, expensive divorce proceedings with lawyers.
Spend your money on your children and your future instead. Safe your energy for when the divorce is over. You’ll need it to rebuild a better, happier life. When you use a professional, trained, educated, up-to-date mediator who has compassion and some common sense, you’ll be well on your way.
You can’t divide more than you have, no matter how hard you fight. You can’t rewrite basic rules and standards, regardless what you’re being promised in that initial consult in the lawyer’s office until you hand over the big retainer. You can’t go backwards and undo the damage.
You can’t force a parent to be or become a good parent, no matter how hard you fight in court. In hindsight you‘ll realize those expensive, nerve wrecking battles weren’t worth it.
So save yourself the aggravation and drama, and work on actual constructive co-parenting plans. A good mediator will assist you in making that a successful endeavor. Make it about your children. Look at the big picture. Focus on the future.

Holistic Divorce?
When you anticipate that a divorce will be overshadowed by lots of emotions, such as sadness, anger, hopelessness, frustration, fear, personality issues, etc. then you should seriously consider using mediation to get divorced, rather than going through the traditional process with attorneys and the courts. The long waiting periods, rulings that don’t address the core issues or are totally unfair, high cost and lack of transparency all add to the drama.
Mediation on the other hand is private and confidential. No topic is tabu. A neutral third party, the professional mediator, works with both parties, facilitating open conversation and longterm resolution for lingering conflicts. Everything is kept private and confidential. The parties then make their own decisions, while the mediator facilitates keeping power imbalances to a minimum, helps sort out the most sensible solutions for future finances and most of all assures that children’s best interests, meaning their physical, mental and emotional health are protected and businesses and careers remain viable.
It’s an involved, complicated process, but one that employs intelligent common sense and true authentic compassion, and one that puts all the humans and their respective happy future in a divorce case first.

Holistic Divorce?
Besides custody the financials and financial future of both parties are most often the biggest issue in a pending divorce. Sorting things out in mediation, especially with a trained, experienced mediator, one who actually understands numbers and their implications, one who has an MBA with concentration in finance, and one who works with both parties simultaneously, sure seems like the most logical option.
It’s all about making things work in the future for two separate homes with the same amount of money. Not having FICO scores destroyed in the meantime.
The process of mediation is so much faster because there are no lengthy detours through various law offices and court hearings. It’s one on one with a neutral third party, the designated mediator, and therefore more truthful, more direct, more child and career centered, simply more common sense.
No subpoenas or contempt hearings in mediation, however full financial disclosure is of course expected to make it work. Omissions or false numbers, i.e. cheating, make any agreements voidable any time in the future and therefore useless. A good mediator with enough financial education can spot the signs and dig deeper, whether it’s in a divorce or any other financial dispute settlement negotiations.
Most importantly, in mediation you are the ones and only ones who decide in the end how, in which way, and when to allocate or distribute your assets and liabilities, and that in the privacy of your own space. That can also include various support payments. You’ll see the standard State guidelines of course, but you can customize them as you wish and make decisions in just days in mediation.

Yes. It’s absolutely not illusory. Quite the opposite.
In my mediation practice we focus on the whole picture. How can we separate finances and property while preserving a home for the children, for example. What’s the best plan to preserve careers to benefit all members of the family is another aspect. We can make plans to maintain and often even restore FICO scores, so both parties will be able to own a home going forward. Our MoU (Memorandum of Understanding)/Settlement Agreement is fully customized with contingencies in place, so finances do not get ruined for either party. Also, not everyone is motivated by money. Sometimes it is more about peace of mind or even convenience. Mediation truly empowers BOTH parties to have direct full input and be heard. As a result our agreements are realistic, fair and long-lasting.
Of course they are legally enforceable as with any divorce.
Lastly, a mediated divorce costs up to 90% less than a traditional litigated divorce.

Holistic Divorce?

A holistic divorce focuses on the future, not beat up and litigate the past. Of course the past matters, emotions absolutely need to be validated, but putting the energy on the future is key. Being able to self-advocate for how that should look like is priceless.

Professional mediation can and will make that happen. A litigated divorce on the other hand prohibits that by design due to the adversary business model. It’s pretty self-explanatory.

‘Fair’ is the “F”-word in divorce. However, in mediation, due to the intrinsic transparency of the process, very fair agreements can and are achieved all the time. Peace matters, money matters, happiness matters, truth matters, mental, emotional and physical health really matter. Perception is a critical part of a divorce. All those aspects can become an important piece of the puzzle of a divorce known as a holistic divorce.

Professional mediation makes it happen and truly creates a better path for the future after divorce.

Holistic Divorce?

A divorce does end a chapter but also starts a new chapter in the life for parents and children alike. Keeping that in mind when going through the divorce is imperative. Using a holistic divorce process that relies on professional, child centered mediation is the only and best way to achieve the goal of a happier healthier future for all involved.
Unfortunately mothers and/or fathers still think they need a bulldog of an attorney to succeed in a divorce. Nothing could be further from the truth. All that accomplishes is forever broken hearts, parent alienation, resentment, financial chaos, scars so deep therapists can only make a dent, and worse.
A holistic divorce through mediation on the other hand will help establish the baseline and ground rules for a peaceful, happy future.
In the heat of the moment parents tend to forget that they will be bound to each other by their children literally until ‘death do they part’.
So why not work on keeping that forever relationship respectful and meaningful with focus on productive, supportive co-parenting going forward.
In my 20 years of practice as a professional mediator I found one thing to be true, children of divorces, where co-parenting was the central focus, remain unscathed by the divorce process. It does however take courage and trust in the process to achieve that. That’s why it’s important to seek a mediator who is trained and experienced in all facets of the child-centered divorce process.
Mediated divorce agreements tend to be much longer lasting and always much quicker and therefore a lot more affordable than traditional litigated divorces.
Some common myths about mediated divorces are that the parties have to be amicable, that one party will get all the money, or that the settlement agreements or MoUs (Memorandum of Understanding) is not legally enforceable. All are absolutely false.
If you are contemplating a divorce then going for a holistic divorce through mediation will be the best decision you ever made for yourself and your children!
