Costs and outcomes are often top of mind when considering litigation. Two of the most common questions clients ask involve financial recovery and what happens after a court decision is issued. With that in mind, we wanted to provide clarity about what may happen at the conclusion of a case.

💠Will the other side pay my attorney fees if I win? Generally, each side pays its own legal fees. However, certain contracts or statutes allow for fee recovery, and courts may award fees in limited circumstances.

💠What happens after a judgment is entered? If you prevail, the court may award damages or other relief. If payment is not made voluntarily, additional legal steps may be necessary to enforce the judgment.

Litigation can feel overwhelming, especially if you have never been involved in a lawsuit before. The legal process is structured, deadline-driven, and often more complex than many people expect. Here are two foundational questions we are often asked about civil and commercial litigation.

💠What is litigation? Litigation is the formal legal process used to resolve disputes through the court system. It typically begins when one party files a complaint, and the other party responds. From there, the case may proceed through discovery, pre-trial motions, and potentially trial.

💠When should I consider filing a lawsuit, and how much time do I have? Litigation is often a last resort after efforts such as negotiation or mediation have failed. Before filing, it is important to evaluate the strength of your claim, the available evidence, and whether a judgment would realistically be collectible. Every legal claim is subject to a statute of limitations, which sets a strict filing deadline. The timeframe depends on the type of case and jurisdiction. Waiting too long can permanently bar your claim.

One of the most common estate planning misconceptions we encounter is that people believe their assets are automatically protected once a trust is created. However, that’s not the case. A trust must be properly funded to be effective, which means that you need to transfer the assets you want to protect into it. Without that step, those assets will likely still go through probate.
