⚖️ One day life is normal… and the next day you are fighting for everything.

A knock at the door.
A phone call you were not expecting.
A traffic stop that turns into charges.
An argument that gets out of control.
A court date with your name on it.
A custody situation that feels like your heart is being ripped out.
A divorce that suddenly becomes a battle.
An accusation that could follow you for the rest of your life.

Legal problems do not always arrive quietly.

Sometimes they come with fear.
Sometimes they come with embarrassment.
Sometimes they come with anger, panic, confusion, and sleepless nights.
Sometimes they make you wonder, “What happens to my kids? My future? My freedom? My name? My life?”

This is not just a case number.

This may be the biggest fight you have ever faced.

I got a slightly spammy sounding email from Microsoft yesterday congratulating me for being a valued member of Bing Places for Business, a thing that I didn't even know existed until that moment. So I checked my website stats and, sure enough, a handful of people found my website through Bing!

As a criminal defense attorney I'm already predisposed to rooting for the underdog, so God bless you brave souls out there who found our website using something other than Google.

And a special shout out to the 244 users who somehow visited my site last month using an operating system called OS/2, which wikipedia says is now primarily used in bank ATMs and supermarket checkout terminals. Shine on you crazy diamonds!

Public Service Announcement - You Gotta Show Up for Court!

Look, I get it’s scary and stressful to show up for any court hearing, especially for a criminal case. But that little voice in your head that’s telling you “if you don’t show up today for court, then nothing bad is going to happen to you today” is lying to you.

What ACTUALLY happens is maybe you get to snooze a little longer that morning, but in the meantime the court revokes your bond and issues a warrant for your arrest. And eventually when the cops find you, you’re going to jail immediately and THEN have to either spend more money to bond out or sit in jail until your next court date. Plus, the State could add a separate charge of Bail Jumping to whatever they’ve already accused you of. So really you’re just making the PROSECUTOR’S job easier!

Also, if you’re running late call your lawyer’s office and let them know! I don’t mind talking to the judge on your behalf if your car broke down or you couldn’t get a ride to court and showed up late. But it’s a much tougher sell if you don’t show up at all.

So do yourself a favor and show up to court!

I can tell you from personal experience (because my law firm has been open for 9 years) that running your own small business is definitely cool. Unfortunately, the downside is as the owner you end up wearing a lot of hats. One of those hats is Information Security, which is one of the last things most small business owners think about while they're busy trying to get customers in the door. It seems like hackers are everywhere these days and even large companies aren't immune. However, if you collect information about your customers, you have a duty to secure that data.

Last year, the Texas Legislature passed a law, Texas Senate Bill 2610, which creates a "safe harbor" for small businesses sued over data breaches. However, business owners only get the protection of the safe harbor IF they follow the law exactly, and what the law requires depends on the size of the business.

My law firm handles criminal and family law, so this post doesn't drive any business to me. BUT, as a fellow small business owner, we all have to stick together. If I can help inform our North Texas community about laws like this and hopefully keep a local business safe, I'm happy to do it.

You can Google "Texas SB2610" if you want to know more. OR, if you want me to create a short video going a little bit more in depth about the legal requirements, let me know in the comments. If there's enough interest from folks, I'm happy to help. Also, if you see this and know a Texas small business owner, please share this post with them - it could help them avoid a costly lawsuit.

One of the cool things about owning your own law firm is that unless I’m in court I have the time to go visit my clients in jail. Some people I talk to are happy, some are sad, and some are just pi**ed off. But I’ve never had a client who was like “man, it really sucks that my lawyer took time out of his busy day to visit me in jail.”

Now they do have video visits (at least in Wichita County), but I’m kind of a face to face guy at heart. And if I’m able to go out and see someone personally, I’ve found I tend to have a better idea where someone’s really coming from and their case can benefit as a result.

So if you’re out in the Free World, as folks in jail tend to call it, and know someone in jail just remember that a visit from a friend or family member can make that person’s day.

And if somehow you’re IN the jail reading this…uhhh…well you don’t have to like this post it’s okay I understand.
