Effective December 19, 2025, S8338 amended to New York’s Human Rights Law to allow employees to base employment discrimination cases on disparate impact, meaning practices that have a “discriminatory effect, even if such practice was not motivated by a discriminatory intent.” Employers must carefully review their employment policies and practices to ensure compliance with the amended law. Effective June 1, the New York State Unified Court System has adopted a new rule, Part 161, addressing the use of AI technology in court filings. The rule notes that existing rules covering the duties and responsibilities of attorneys who submit papers to a court apply with equal force to papers created using AI, and that AI usage therefore need not be disclosed in any filing.

Part 161 also includes a “Model Rule” that courts may adopt on a discretionary basis, specifically covering the duty to ensure that an AI-generated filing “contains no fabricated or fictitious cases, statutes, or other material.” It remains to be seen whether any courts in New York adopt the Model Rule.

While involving a New Jersey entity, the U.S. Supreme Court’s April ruling in First Choice Women’s Resource Centers, Inc. v. Davenport has set a critical precedent for New York-based non-profits regarding donor privacy. In a significant win for non-profit advocacy groups, the Court ruled against a state attorney general's broad subpoena for donor records. Justice Gorsuch’s opinion emphasized that "compelled disclosure of affiliation" can act as a restraint on freedom of association. This ruling limits the ability of state regulators to demand private donor lists under the guise of consumer protection investigations.
