Fullerton Beck Prevails in Highly Publicized Negligence Case
In a highly publicized negligence action arising from the tragic death of a young mother at a New York City family shelter, Heather Julien secured summary judgment dismissing all claims against a maintenance contractor. The case was filed by the decedentโs daughterโs father as a result of the child being found alone with her mother after her passing.
Although included in the case due to its presence at the facility, Fullerton Beck demonstrated that the contractorโs role was limited to maintenance services and did not involve resident supervision, safety, or welfare, the central allegations in the action, and plaintiffs ultimately did not oppose the motion. The court agreed, finding no basis for liability and removing the client from the case in its entirety.
