Have you recently received an FBI Privacy Notice from USCIS in the mail?
I received a whole bunch of notices … just about one for every pending case. While it is never fun to get a letter from the FBI, don’t stress! USCIS has been sending these notices out in large numbers, and the notice is clear: THERE IS NO FURTHER ACTION NEEDED FROM YOU.
While USCIS has not officially explained the reason for the recent notices, many immigration attorneys believe they may be related to internal changes involving FBI and USCIS background checks.
But what does the notice mean?
USCIS may now continuously check your biometrics—such as fingerprints and facial images—against FBI databases while your case is pending.
So, while you do not need to do anything because of this notice, it is still important to tell your immigration attorney if you are arrested or have an encounter with law enforcement. Your attorney needs to know about these encounters so they can determine whether they could affect your immigration case.
