$800,000 Judgment Upheld by Massachusetts Appeals Court:
Curran & Desharnais, P.C. is pleased to announce that the Massachusetts Appeals Court has recently upheld a jury verdict and Judgment that Attorney Curran obtained against a large General Contracting and Design corporation for approximately $800,000.00, which he obtained for a client in connection with a construction contract dispute. Attorney Curran represented a subcontractor which had been wrongfully terminated from a large construction project on the South Shore. The defendant General Contractor claimed the parties never entered into a formal contract and therefore, were within their rights to terminate. After a 4 day jury trial, Attorney Curran secured a substantial jury verdict in his client’s favor where the jury agreed that the parties had in fact entered into an agreement sufficient to form a contract and found the defendant breached the parties’ contract and also found that the defendant violated provisions of M.G.L. c. 93A for acting in bad faith thus, opening the door for an additional award of double or triple damages against the defendant. Shortly thereafter, the defendant appealed the verdict and after failing to take the necessary steps to pursue its appeal rights, Attorney Curran was successful in obtaining a dismissal of the defendant’s appeal after filing multiple motions in Superior Court. Upon a request for reconsideration filed by the defendant, the appeal was ultimately allowed to move forward; however, after finding no abuse of discretion by the trial judge or error of law, the Massachusetts Appellate Court upheld the jury verdict obtained by Attorney Curran eventually resulting in payment being made to his client for damages sustained as a result of the defendant’s breach and bad faith
