🔑🤍 I send this reminder periodically because I continue to receive questions about who customarily pays for title insurance in the various counties throughout Florida.

Please feel free to use the county map below as a quick reference when preparing and negotiating contracts. As you’ll notice, in the majority of Florida counties, it is customary for the seller to pay for the owner’s title insurance policy.

It is important to remember that the selection in the contract regarding who pays for the title insurance premium is not based on Florida law, but rather on local custom and negotiation between the parties.

Under the Florida Realtors/Florida Bar contract, Paragraph 9(c)(i), (ii), or (iii) (including the Miami-Dade/Broward Regional Provision where applicable) determines which party designates the title company and pays the title insurance premium(s).

proposal by Ron DeSantis to significantly reduce—and eventually eliminate—property taxes on homesteaded primary residences in Florida. The proposal has been widely discussed and is based on real policy announcements, but some of the numbers shown in the graphic are debated.

What the proposal would do

* Increase the homestead exemption from the current $50,000 to a much larger amount.
* Eventually move toward eliminating property taxes on primary residences (homesteaded homes).
* Continue taxing investment properties, rentals, second homes, and commercial properties.

Important: It is not law yet

For this type of constitutional change to take effect, it must:

1. Pass the Florida Legislature.
2. Appear on a statewide ballot.
3. Receive at least 60% voter approval.

Why homeowners support it

Many Florida homeowners have seen:

* Higher property values
* Higher property taxes
* Rising insurance costs

Supporters argue that homeowners should receive substantial tax relief on their primary residence.

Why critics oppose it

Can Sellers Demand Closing Funds Before Delivering Keys?

This issue continues to arise in Florida real estate transactions, so it’s worth revisiting.

According to the Florida Realtors®/Florida Bar Residential Contract, sellers are required to deliver all keys, garage door openers, access devices, and codes at closing. Once the closing agent confirms that the transaction has officially closed, the buyer is entitled to possession unless otherwise agreed in writing.

A common misunderstanding occurs when a seller insists on seeing sale proceeds deposited into their bank account before releasing the keys. However, wire transfers are often processed after closing, and delays can occur due to banking hours, weekends, or holidays.

Key points:

✅ Closing occurs at the time established by the Closing Agent.

✅ Sellers are contractually obligated to deliver keys and access devices at closing.

✅ Funds are typically disbursed after closing and recording.

✅ A seller’s refusal to provide keys after closing could expose them to liability for damages incurred by the buyer, such as moving expenses, storage fees, temporary lodging, or rescheduled deliveries.

In many cases, providing proof that the seller’s wire has been initiated is enough to resolve the issue.

As always, Realtors® should avoid providing legal advice and encourage buyers and sellers to consult legal counsel regarding contractual rights and obligations.
