After being charged with a DUI, it’s worth knowing that the evidence against you may not always be as solid as it seems. Experienced lawyers like attorney Kevin Churchill can challenge how that evidence was collected, and if something was done improperly, like an unlawful traffic stop or a faulty breathalyzer test, they may be able to get it thrown out. Having key evidence suppressed can significantly weaken the case against you and potentially lead to reduced charges or even a dismissal.

In order to suppress evidence the court has against you, an attorney may file motions with the court, and conduct a hearing to examine the police officer.

Governor Polis recently signed Magnus' Law, a new piece of legislation that relates to DUI offenses. While Magnus' Law requires officers to offer a breathalyzer test at the scene of a serious or fatal crash, drivers cannot be forced to take it. The roadside test itself cannot be used as evidence in court. However, it can give officers probable cause to make an arrest and request a more formal evidentiary test at the station, which does carry penalties if refused and can be used against the driver in court.

This article describes a new Colorado DUI law that requires law enforcement to offer a voluntary breath test at accident scenes.

If you’re pulled over on suspicion of a DUI, it’s important to remain calm, be polite to the officer, and avoid making any statements that could be used against you later, as you have the right to remain silent. You may be asked to perform field sobriety tests or submit to a breathalyzer, so you should understand your rights before complying with any requests. Once arrested, your most important next step is to contact an experienced DUI attorney as soon as possible. Having legal representation early in the process can make a significant difference in the outcome of your case.

When a driver is pulled over on suspicion of drunk or impaired driving, the officer will observe their behavior, ask questions, and administer Standardized Field Sobriety Tests to determine whether there is enough evidence to make an arrest. From there, the suspect is taken to the station for chemical testing, which can include a breath, blood, or urine test. In cases where drug impairment is suspected, a specially trained Drug Recognition Expert (DRE) may be called in to perform a detailed evaluation. Once the investigation is complete, the suspect is booked into the county jail, fingerprinted, and typically brought before a court within 24 hours of being detained.
