When it comes to creating a will, one of the most important decisions you'll make is choosing the right executor. The executor plays a crucial role in ensuring that your wishes are carried out after your passing, so it's essential to make this decision carefully.

An executor, also known as a personal representative in some states, is the individual responsible for managing your estate and ensuring that your assets are distributed according to the terms of your will. Their duties may include:

Filing court documents: The executor initiates the probate process by filing necessary documents with the court.

Inventorying assets: They create an inventory of your assets and debts, which is crucial for estate settlement.

Notifying beneficiaries: Executors are responsible for notifying beneficiaries and creditors of the estate.

Paying debts and taxes: They use estate funds to pay outstanding debts, taxes, and administrative expenses.

Distributing assets: Once debts and expenses are settled, the executor distributes the remaining assets to the beneficiaries as outlined in the will.

Eccentric industrialist Howard Hughes died in 1976. Although he left behind a $2.5 Billion estate, he died with no will, setting the state for an epic estate battle that took 34 years to settle.

Incredibly, more than 40 different wills were produced, all of which proved to be fakes. All told, more than 600 people came forward with claims in Hughes' fortune, many with wild tales of their connection to the billionaire.

In the end, the estate was settled under intestacy laws, and 22 of Hughes' legal cousins divided the fortune.

Even if you are not a billionaire (and you weren't played by Leonardo DiCaprio) - an estate plan is essential to ensure that your wishes are carried out and your assets are distributed in a timely manner to those you love the most.

Pablo Picasso died at the age of 91, and despite his fame and fortune, did not have a Will. He owned five homes and assets valued at $250 million ($770.94 million in today's dollars), including more than 40,000 original works of art. He had been married twice and had four children, and the fight over his estate cost more than $30 million and took many years. Hopefully this paints a clear picture for you - everyone should have an estate plan.
