Serious injuries result when a tram crashes at Universal Studios Hollywood. My remarks can be found throughout the video.

Just spoke with the LA Times regarding the tram accident at Universal Studios this last weekend. My clients suffered serious injuries in this accident, but you wouldn’t think that after reading the one-sided articles being pumped out by various news agencies.

Did you know the tram appears to have sped up to approximately 20-25 miles per hour before crashing into the guard rail?

While the tram was out of control, there is no indication any warnings/announcements were made, coupled with the fact there were no seatbelts or doors/rails to protect the passengers.

A tram accident at Universal Studios Hollywood injured 15 riders on Saturday night, according to authorities.

These last couple weeks I have had to file many "Underinsured Motorist" personal injury claims with my client's own insurance carrier. This can only occur when the at-fault driver is uninsured or the at-fault party's insurance carrier has offered to settle the underlying injury claim for the at-fault party's policy limits.
When a client first presents to me, I always request a copy of their car insurance "Declarations" page to determine (a) whether they have Uninsured/Underinsured Motorist Coverage (UM/UIM) and if so, (b) what amount of coverage they have.
The importance of understanding how UM/UIM works is great because in many ways, UM/UIM limits represent the maximum compensation the client should expect to receive, short of filing a lawsuit/entering into arbitration.
For example: Bob is injured when David crashes into him. Bob suffers some pretty serious injuries. David only has a minimum insurance policy of $15,000.00. Fortunately, Bob has Underinsured motorist coverage of $100,000.00. This means Bob can receive a maximum of the highest of the two policies. In this case, $100,000.00 of compensation is available to cover Bob's medical bills, lost wages and pain and suffering.
California does not allow you to 'stack' policies. This is why Bob is only entitled to $100,000 total, not $115,000.00. I always recommend that clients and non-clients purchase as much UM/UIM coverage they can afford. It is relatively cheap and will protect you if you are injured by one of the countless uninsured drivers on California's roads.

YOUR FRIEND INJURED YOU WHILE DRIVING YOUR CAR?

Assume you, the owner of the car, are in the car while your friend is driving it, and your friend gets in an accident, resulting in you being injured. Can you pursue your friend for your injuries even though your friend was driving your car with your permission?

Subject to two very specific exceptions, where the owner of a vehicle allows someone else to drive his/her vehicle and the owner suffers personal injuries when the driver causes an accident, the owner cannot pursue civil damages against the at-fault driver. For example, you want your friend to drive you to a concert. While your friend is driving, he runs through a red light and crashes into another vehicle. You sustain personal injuries as a result. Because you allowed your friend to operate your vehicle, you are not allowed to pursue a claim for personal injuries against him/her unless the accident was subject to at least one of the two available exceptions.

The first exception allows you to pursue the driver if you can prove they were intoxicated at the time of the accident. The other exception allows you to pursue the driver if you can prove they willfully caused the accident. This rule is codified under CVC 17158.

There is much debate as to why this rule has been set under California law. One of the leading rationales is that the owner is the sole individual who is in the best position to determine who he/she wants to have drive his/her vehicle. As such, the owner is best equipped to choose a competent and responsible individual to drive their car. Thus, it would be “unfair” for the owner to later pursue that driver if the driver injures them in an accident because the owner could have prevented the accident (in theory) by not allowing the other person to drive the car in the first place.

What do we all think about this rule? Too strict? Just right?
