carriers have decided to give drivers a break and provide small credits to policyholders for the affected weeks of the COVID-19 related shutdowns. This link to the NJ Law Journal may be password protected, but the subject is that New Jersey has extended immunity to medical professionals for acts of negligence that may occur in dealing only with COVID-19 patients. The law is restricted to COVID-19 care, it is not a general grant of immunity but rather targeted. The bill is framed as: “An act providing immunity from liability for certain claims alleging injury or death during public health emergency and state of emergency and facilitating issuance of temporary licenses and certifications. Applicable to any health care facility and any other site designated by the Commissioner of Health for temporary use for the purpose of providing essential services in support of the State’s response to the outbreak of Coronavirus disease during the public health emergency and state of emergency declared by the Governor in Executive 17 Order 103 of March 9, 2020.“ Cases of fraud, gross negligence and recklessness are exempt under the bill. The legislation was passed nearly unanimously in both legislative branches despite certain valid and credible concerns. The dramatic nature of this emergency is a solid reason to make sure that all hands are on deck to deal with very sick patients.

S-2333/A-3910, which mirrors legislation in other states, stirred debate in both houses before passing the Legislature Monday. It was signed into law Tuesday.
