Withdrawing an I-140 petition does not automatically close the door on prior issues.

If there were concerns in a previous filing, USCIS may still rely on those findings and raise them again in a new or subsequent petition.

This means a withdrawal does not necessarily “reset” your case. Any prior inconsistencies, misrepresentations, or eligibility concerns may still need to be addressed.

If your I-140 is approved and your I-485 has been pending for 180 days or more, you may be eligible to port to a same or similar job under AC21 portability.
