One of the most common mistakes I see individuals being investigated make is making statements to an investigator. Often, those statements aren’t recorded and you’re stuck in a situation where things are misunderstood, remembered incorrectly or are admissions of guilt. Everyday Iowans are often surprised by what constitutes a crime or what level of crime their actions are. Detectives and officers are trained to ask questions to elicit information to help them build their case. Often, completely innocent behavior can be misconstrued to appear to be a crime.

So what should you do? Unequivocally invoke your right to remain silent and state that you want to speak with an attorney before making any statements. Remember, the officers/detectives are not the enemy and are just doing a job. A job that many of us have benefited from at one point or another. It’s important to be respectful, non-confrontational and call a lawyer.

Criminal Defense Attorney, Nicholas Lombardi would like to remind you to celebrate freely and Drive Responsibly this 4th of July!

Guys and gals Buzzed driving is drunk driving, and that’s the absolute truth, many of the OWI clients that we serve provided a chemical test that was just over the legal BAC limit of 0.8 and I have yet to come across anyone that tells me that it was the right decision.

The penalties and consequences of an OWI far outweigh the convenience of having your car to get yourself home or looking “cool” for your friends. If you only focus on the financial penalty perspective, you are looking at at least $1,250.00 for fines (not including surcharges and court costs), plus the cost of a breathalyzer and SR 22 Insurance.
Did you know that the average insurance rate Increase for your OWI/DUI offense is 89%? In dollars that equates to an additional $1,300 per year?

And we aren’t even covering the cost of an attorney, which can help you dissect each of the specific events of your traffic stop, your interview with the officer from the legal perspective, and help you win the case.

Needless to say getting a designated driver or a service like Uber or Lyft even if the cost is $100, which far outweighs the financial, emotional, and criminal record which may have long their impacts on your future.

Purchasing a used car? Lying to the DMV about what you paid for a car can land you in serious trouble. It's referred to as "Fraudulent Practices" and is covered under Iowa Code Section 714.8.

The "level" or degree of the charge depends on the value of the vehicle. This is based on the difference in what you actually paid for the vehicle and what you said you actually paid for the vehicle and NOT the amount of tax avoided. For instance saying a car was free when you in fact paid $5,000.00 could be charged as a Class D Felony even if the tax avoided was only $250.00.

Fraudulent practices in the first degree (Iowa Code Section 719.9) is charged when the value of the property involved exceeds $10,000.00. Fraudulent practices in the first degree is a C Felony punishable by up to 10 years in prison and a fine of up to $10,000.00.

Fraudulent practices in the in the second degree (Iowa Code Section 719.10) is charged when the value of the property involved exceeds $1,500.00 but does not exceed $10,000.00. Fraudulent practices in the first degree is a D Felony punishable by up to 5 years in prison and a fine of up to $7,500.00.

Fraudulent practices in the in the third degree (Iowa Code Section 719.11) is charged when the value of the property involved exceeds $750.00 but does not exceed $1,500.00. Fraudulent practices in the third degree is an aggravated misdemeanor punishable by up to 2 years in prison and a fine of up to $6,250.00.

Fraudulent practices in the in the fourth degree (Iowa Code Section 719.12) is charged when the value of the property involved exceeds $300.00 but does not exceed $750.00. Fraudulent practices in the third degree is a serious misdemeanor punishable by up to 1 year in the county jail and a fine of up to $1,875.00.

Fraudulent practices in the in the fifth degree (Iowa Code Section 719.13) is charged when the value of the property involved does not exceed $300.00. Fraudulent practices in the fifth degree is a simple misdemeanor punishable by up to 30 days in jail and a fine of up to $625.00.

Happy New Year! Make sure to start this year out with a bang and rememeber, don't drink and drive! In Iowa an OWI first offense carries a fine of $1250.00, a 35% surcharge ($437.50), $100.00 in court costs, an average of $75.00 for an evaluation, $375.00 for the OWI first class, around $150.00 for the install of the breathalyzer, $75.00 a month fee for the breathalyzer, a $200.00 civil reinstatement fee so that you can drive, and SR22 for insurance. All this and we haven't even paid the lawyer yet!

On July 1, 2019 a new Iowa law took effect which now allows certain crimes to be removed from public viewing. This is technically called expungement. This does not erase your criminal history but seals the court file. The requirements of the new law are:

1. Applies to misdemeanors only.
2. More than 8 years have to have passed since the conviction.
3. You can have no pending criminal charges.
4. All of your financial obligations of the prior case must be paid.
5. You cannot have received/used 2 deferred judgments.
6. You are only allowed one lifetime expungement under this law.

A conviction under §123.46 – Public Intoxication (still eligible under §123.46(6))
A conviction under §123.47 or similar ordinance - Possession of Alcohol Under Legal Age (still eligible under §123.47(8))
A conviction for dependent adult abuse under section 235B.20.
A conviction under section 321.218, 321A.32, or 321J.21. (certain drivers license related offenses)
A conviction under section 321J.2. (OWI)
A conviction for a s*x offense as defined in section 692A.101.
A conviction for involuntary manslaughter under section 707.5.
A conviction for assault under section 708.2, subsection 3. (assault while using or displaying a dangerous weapon).
A conviction under section 708.2A. (domestic abuse)
A conviction for harassment under section 708.7.
A conviction for stalking under section 708.11.
A conviction for removal of an officer's communication or control device under section 708.12.
A conviction for trespass under section 716.8, subsection 3 or 4. (with intent to commit a hate crime)
A conviction under chapter 717C. (be******ty)
A conviction under chapter 719. (obstructing justice including interference with official acts and providing false identification information)
A conviction under chapter 720. (interference with judicial process including perjury and malicious prosecution)
A conviction under section 721.2. (misconduct in [public] office]
A conviction under section 721.10. (misuse of public records or files)
A conviction under section 723.1. (riot)
A conviction under chapter 724. (weapons related offenses)
A conviction under chapter 726. (related to the protection of family and dependents including child endangerment)
A conviction under chapter 728. (obscenity related offenses)
A conviction under chapter 901A. (s*xually predatory offense)
A conviction for a comparable offense listed 49 C.F.R. §383.5l(b) (table 1) or 49 C.F.R. §383.5l(e) (table 4). (certain CDL related offenses)
A conviction under prior law of an offense comparable to an offense enumerated in this subsection.
